Resumen : La reparación integral es un derecho que tienen las víctimas, que procura restablecer la situación anterior a la violación y puede incluir diferentes medidas a partir del Derecho Constitucional y del Derecho Internacional de Derechos Humanos. Esta investigación tuvo como objetivo analizar el derecho a la reparación integral en su aspecto inmaterial a la luz del principio de interés superior del niño y de su dignidad, conforme a la sentencia reservada del caso AAMPETRA del año 2016. Siguiendo una metodología fundamentada en un enfoque cualitativo y de tipo descriptivo, con uso de la hermenéutica como técnica, se realizó un análisis documental del procedimiento del caso a partir de los testimonios de las víctimas y de sus familiares. Se concluyó que la sentencia reservada del caso AAMPETRA, vulneró derechos constitucionales, con base en los parámetros del Derecho Constitucional y del Derecho Internacional sobre derechos humanos. Se elaboró una propuesta que contiene alternativas que procuran el correcto cumplimiento del mandato constitucional en esta temática en casos de abuso sexual infantil.

Descripción : Comprehensive reparation is a right that victims have, which seeks to restore the situation prior to the violation and can include different measures based on Constitutional Law and International Human Rights Law. This research aimed to analyze the right to comprehensive reparation in its immaterial aspect in light of the principle of the best interest of the child and his dignity, in accordance with the reserved judgment of the AAMPETRA case of 2016. Following a methodology based on an approach Qualitative and descriptive, using hermeneutics as a technique, a documentary analysis of the case procedure was carried out based on the testimonies of the victims and their next of kin. It is concluded that the reserved judgment in the AAMPETRA case violated constitutional rights, based on the parameters of Constitutional Law and International Law on human rights. A proposal was prepared that contains alternatives that seek the correct fulfillment of the constitutional mandate on this issue in cases of child sexual abuse.
