Resumen
El presente trabajo de investigación respondió a la situación problemática sobre la insuficiente integración del pluralismo jurídico y la justicia indígena en los programas de Derecho de las universidades de la provincia de Imbabura, pese a los principios constitucionales sobre pluralismo e interculturalidad, por lo cual la pregunta del problema fue: ¿Cuáles son los criterios que podrían garantizar la integración del pluralismo jurídico y la justicia indígena en las mallas curriculares de las carreras de Derecho, en el caso de la provincia de Imbabura durante el año 2023?. El objetivo general fue: investigar los criterios a través de los cuales se podría integrar al pluralismo jurídico y justicia indígena en las mallas curriculares de Derecho en las instituciones universitarias, la metodología utilizada: enfoque de investigación a aplicar: cualitativo, así como el tipo de investigación: descriptivo, junto al método descriptivo, las técnicas fueron, entrevista y análisis documental; el instrumento de investigación: entrevista semiestructurada. Como conclusiones se destaca que, aunque existen bases normativas sólidas, la integración del pluralismo jurídico y la justicia indígena en las mallas curriculares de Derecho en Imbabura es limitada y requiere un mayor enfoque práctico, entre otros, Como recomendaciones, se debe fortalecer el pluralismo jurídico y la justicia indígena en los currículos de las universidades, e implementar enfoques prácticos, además de capacitación a docentes.
This research work addressed the problematic situation regarding the insufficient integration of legal pluralism and indigenous justice in the law programs of universities in the province of Imbabura, despite the constitutional principles of pluralism and interculturality. Therefore, the research question was: What criteria could guarantee the integration of legal pluralism and indigenous justice into the curricula of law programs in the province of Imbabura during the year 2023?. The general objective was to investigate the criteria through which legal pluralism and indigenous justice could be integrated into the law curricula in university institutions. The methodology used was a qualitative research approach, with a descriptive type of research, along with the descriptive method. The techniques used were interviews and document analysis, and the research instrument was a semi-structured interview. The conclusions highlight that, although there are solid normative bases, the integration of legal pluralism and indigenous justice into the law curricula in Imbabura is limited and requires a more practical focus, among other things. As recommendations, it is suggested to strengthen legal pluralism and indigenous justice in university curricula and to implement practical approaches, as well as to provide training for teachers.
