Resumen
En la actualidad, el desarrollo sostenible y sustentable es una de las mayores preocupaciones debido a las consecuencias que la actividad humana tiene en el medioambiente. El consumo es una de las principales fuentes de contaminación a nivel global, razón por la cual se hace urgente implementar medidas para disminuir su impacto. El objetivo de este trabajo consistió en identificar distintas alternativas basadas en el acceso a la información para promover un consumo que sea responsable con el medioambiente, por lo cual se han analizado de forma cualitativa varias iniciativas legislativas de países europeos y contrastándolas con el marco constitucional y normativo ecuatoriano a fin de determinar su viabilidad jurídica. Esto ha permitido determinar que cuando la información se representa de forma adecuada, los consumidores valoran positivamente aquellos bienes que tienen una menor huella ambiental con respecto a las otras alternativas en el mercado que no consideran este aspecto. En contraste, y ya en el ámbito nacional y desde la óptica constitucional, aun cuando es deber del Estado impulsar un desarrollo económico y productivo sustentable y equilibrado con la naturaleza, en el área legislativa el rol del consumidor solo se ha abordado parcialmente, y se ha concluido que todavía es necesario una política integral en materia ambiental dirigida a fomentar hábitos de consumo más sustentables que se ajusten a los estándares constitucionales.
Currently, sustainable, and sustainable development is one of the most significant concerns due to human activity’s consequences on the environment; Consumption is one of the primary sources of pollution at a global level, so it is urgent to implement measures to reduce its impact. The objective of this work was to identify alternatives based on access to information to promote environmentally responsible consumption, for which several legislative initiatives of European countries have been analyzed and contrasted with the Ecuadorian constitutional and regulatory framework to establish its legal viability, determining that When the information is adequately presented to consumers, they positively value those goods that have a smaller environmental footprint compared to other alternatives on the market that do not consider this aspect. In contrast, at the national level and from the constitutional point of view, even when the State must promote sustainable economic and productive development balanced with the preservation and protection of nature, the role of the consumer has been addressed only partially in the legislative branch of the State, concluding that a comprehensive policy on environmental matters is still necessary, aimed at promoting more sustainable consumer habits that conform to constitutional standards.
