Resumen
Este trabajo aborda la problemática de la posible vulneración del derecho a la reparación integral de la víctima cuando el sentenciado se acoge a la suspensión condicional de la pena en el procedimiento abreviado. Se cuestiona la idoneidad de aplicar la suspensión condicional antes de asegurar la reparación integral de la víctima. El objetivo fue identificar si existe vulneración al derecho a la reparación integral. Se espera que esto contribuya a mejorar el sistema legal, equilibrando la rehabilitación del infractor con la protección de los derechos de la víctima. Diversos estudios evidencian que el incumplimiento de penas privativas de libertad no garantiza la rehabilitación efectiva. La suspensión condicional surge como una alternativa para aquellos con penas no superiores a 5 años que optan por el procedimiento abreviado. La investigación utilizó una metodología cualitativa, respaldada por métodos analítico-sintético y deductivo. Se emplearon instrumentos como entrevistas y análisis documental, realizando un análisis comparativo de casos para evaluar el cumplimiento de la reparación integral en situaciones de suspensión condicional de la pena. Los resultados mostraron que no siempre se garantiza la reparación integral a la víctima cuando el sentenciado se acoge a la suspensión condicional de la pena en el procedimiento abreviado. Como solución, se propuso solicitar a la Asamblea Nacional del Ecuador la reforma del numeral 7 del Art.631 del Código Orgánico Integral Penal. La reforma sugiere que el sentenciado deba cancelar al menos el 50% de la reparación integral acordada antes de beneficiarse de la suspensión condicional de la pena.
This paper addresses the problem of the possible violation of the victim's right to full reparation when the sentenced person is granted a conditional suspension of the sentence in the abbreviated procedure. It questions the appropriateness of applying the conditional suspension before ensuring full reparation to the victim. The objective was to identify whether there is a violation of the right to full reparation. It is hoped that this will contribute to improving the legal system, balancing the rehabilitation of the offender with the protection of the victim's rights. Several studies show that the non-compliance with prison sentences does not guarantee effective rehabilitation. Conditional suspension emerges as an alternativefor those with sentences not exceeding 5 years who opt for the abbreviated procedure. The research used a qualitative methodology, supported by analytical-synthetic and deductive methods. Instruments such as interviews and documentary analysis were used, carrying out a comparative analysis of cases to evaluate the fulfillment of integral reparation in situations of conditional suspension of the sentence. The results showed that integral reparation to the victim is not always guaranteed when the sentenced person is granted conditional suspension of the sentence in the abbreviated procedure. As a solution, it was proposed to request the National Assembly of Ecuador to reform paragraph 7 of Article 631 of the Organic Integral Penal Code. The reform suggests that the sentenced person must pay at least 50% of the agreed full reparation before benefiting from the conditional suspension of the sentence.
