Abstract

En el presente artículo profesional de alto nivel tiene como objetivo y justificación el sustento en la Ley para Erradicar la Violencia ya que en esta se menciona que la Junta Cantonal es quien otorga las medidas de protección ya que es un ente administrativo y tienen la potestad de hacerlo, el objetivo general discutir jurídicamente sobre las Medidas de Protección dictadas por la Junta Cantonal en cuanto a la justificación la Junta Cantonal al dictar las Medidas de Protección se necesita saber el fundamento que este ente administrativo utiliza al momento de emitir las Medidas de Protección, la pertinencia esta realizada con el análisis de las instituciones básicas del proceso penal, conforme a las características de los sistemas de corte acusatorio, importancia trataremos de dar una resolución aporte teórico respecto al problema de investigación el cual se enfoca en que no existe un fundamento adecuado al momento de otorgar las medidas de protección, esta investigación se desarrolló bajo un enfoque cualitativo con un nivel descriptivo y explicativo de tipo documental a través del método deductivo con hermenéutica jurídica con técnicas de análisis documental, concluyendo que no existe un fundamento adecuado al momento de otorgar las medidas de protección
