Resumen
El artículo se centra en la conciliación en accidentes de tránsito en el cantón Quinindé en el periodo 2021-2022 y tiene por objeto orientar a los conductores y víctimas de accidentes de tránsito, para que utilicen la conciliación como una herramienta de solución al conflicto. Este mecanismo evita el congestionamiento de los procesos en las unidades judiciales, busca consolidar la cultura de paz y a su vez fortalece la justicia restaurativa que, tantas veces se busca en el ámbito penal y de tránsito. Metodológicamente, se empleó el método analítico y con un enfoque mixto, se utilizó la investigación cuantitativa y cualitativa. Asimismo, para esta investigación se empleó fuentes documentales, y en cuanto a la técnica, se realizó el análisis de datos obtenidos del Consejo de la Judicatura y de la Fiscalía con respecto al cantón Quinindé. Con este trabajo investigativo, se profundizó sobre este mecanismo de solución de conflictos como una forma extraordinaria de terminar el proceso, poniendo en juego el diálogo y la voluntariedad de las partes. Además, se recalcó que se limita la intervención punitiva del estado, ya que el fin de la materia penal, no es propiamente sancionar, sino buscar una reparación de tipo integral. Consecuentemente, se concluyó que con la conciliación se logra cumplir uno de los principios que persigue el estado, que es el buen vivir, puesto que con esto se propende a vivir en una cultura paz, en donde se deja de rendir culto a la cultura del litigio.
The article focuses on conciliation in traffic accidents in the Quinindé canton in the period 2021-2022 and aims to guide drivers and victims of traffic accidents to use conciliation as a conflict resolution tool. This mechanism avoids congestion of processes in judicial units, seeks to consolidate the culture of peace and at the same time strengthen restorative justice, which is so often sought in the criminal and traffic spheres. Methodologically, the analytical method was used and with a mixed approach, quantitative and qualitative research was used. Likewise, for this investigation documentary sources were used, and in terms of technique, the analysis of data obtained from the Council of the Judiciary and the Prosecutor's Office with respect to the Quinindé canton was carried out. With this investigative work, this conflict resolution mechanism was delved into as an extraordinary way to end the process, putting dialogue and the voluntariness of the parties into play. Furthermore, it was emphasized that the punitive intervention of the state is limited, since the purpose of criminal matters is not to punish, but to seek comprehensive reparation. Consequently, it is concluded that with conciliation it is possible to fulfill one of the principles pursued by the state, which is good living, since with this we tend to live in a culture of peace, where we stop worshiping the culture of litigation.
