Resumen
El presente trabajo de investigación es un estudio de la discrepancia laboral entre trabajadores que se encuentran bajo el régimen del Código de Trabajo y la Ley Orgánica de Servicio Público LOSEP, en relación a la inobservancia del principio constitucional de igualdad, respecto al goce efectivo del derecho a vacaciones; el objetivo general de este trabajo, se centra en establecer la incidencia entre el régimen laboral contenido en el Código del Trabajo y la Ley Orgánica de Servicio Público LOSEP en contraposición con el principio constitucional de igualdad enmarcado en la Constitución de la República del Ecuador. Para el desarrollo del presente trabajo se utilizó una metodología con enfoque documental, no experimental y correlacional. Una vez realizada la investigación bibliográfica, documental y de campo, se pudo evidenciar de forma latente, la existencia de la vulneración del goce efectivo del derecho a vacaciones para servidores y obreros, debido a la inequidad con la que se aplica este beneficio, esto, dependiendo del cuerpo legal al cual se someten las diferentes actividades laborales, estos son, el Código del Trabajo y la LOSEP; ante estos particulares, queda clara la necesidad urgente de una restructuración legal que tienda a modificar los cuerpos normativos vigentes, acción que desembocaría en una aplicación efectiva del derecho de igualdad, y por ende, en el cumplimiento de preceptos constitucionales e internacionales relacionados con los derechos laborales en situación de igualdad.

Once the bibliographic, documentary and field research was carried out, it was possible to latently demonstrate the existence of the violation of the effective enjoyment of the right to vacations for servants and workers, due to the inequity with which this benefit is applied, this, depending on the legal body to which the different work activities are subject, these are the Labor Code and the LOSEP; Given these particulars, the urgent need for a legal restructuring that tends to modify the current regulatory bodies is clear, an action that would lead to an effective application of the right to equality, and therefore, in compliance with constitutional and international precepts related to human rights. employment in a situation of equality.
