Resumen
El estudio del delito de sobreprecio en la contratación pública es un tema crucial dentro del contexto del proceso penal y presentará una serie de problemas jurídicos que deben ser abordados. En el desarrollo de este artículo científico en base al análisis de investigación documental, doctrinaria y de las normas nacionales sustentará que la existencia de sobreprecios en la contratación pública establecidas en el Art. 294.1 del COIP, es una forma y modalidad del delito de peculado; puesto que, al realizarse procesos de contratación pública en los cuales se adjudique contratos con eminente sobreprecio, constituye un abuso y disposición arbitraria de dineros públicos; en vista que se está utilizando los recursos estatales de manera indebida, injustificada y sin austeridad, no existe una optimización de los recursos estatales; esto es lo que justamente se sanciona en el delito de peculado, por lo cual, el tipo penal del Art. 294.1, no debe ser un delito autónomo e independiente; sino que debe ser considerado como uno más de los numerales del Art. 278 del COIP. Dentro de los problemas jurídicos que se presentará es la prescriptibilidad de la conducta; la prohibición de juzgar en ausencia, además que crea un requisito de procedibilidad; en vista que para el procesamiento de la conducta se requerirá de un informe de Contraloría General del Estado que determine la existencia del sobreprecio en contratación pública.
The study of the crime of overpricing in public procurement is a crucial issue within the context of criminal proceedings and will present a series of legal problems that must be addressed. In the development of this scientific article based on the analysis of documentary, doctrinal research and national standards, it will be supported that the existence of surcharges in public procurement established in Art. 294.1 of the COIP, is a form and modality of the crime of embezzlement; since, when public procurement processes are carried out in which contracts are awarded with eminent overpricing, it constitutes an abuse and arbitrary disposal of public money; Given that state resources are being used improperly, unjustified and without austerity, there is no optimization of state resources; This is what is precisely punished in the crime of embezzlement, which is why the criminal offense of Art. 294.1 should not be an autonomous and independent crime; but rather it should be considered as one more of the numerals of Art. 278 of the COIP. Among the legal problems that will arise is the prescribability of conduct; the prohibition of judging in absentia, which also creates a procedural requirement; Given that the processing of the conduct will require a report from the State Comptroller General's Office that determines the existence of the overpricing in public procurement.
