Resumen
El acceso a la justicia se perfila como uno de los derechos más importantes por lo que el trabajo tuvo como objetivo general analizar el acceso a la justicia como derecho de los pueblos y nacionalidades indígenas del Ecuador. Para el desarrollo se utilizó una metodología con enfoque cualitativo y una investigación de tipo descriptiva. Se aplicó una entrevista semi - estructurada contentiva de cinco (5) preguntas, aplicadas a ocho (8) participantes: tres (3) Jueces, uno (1) Agente Fiscal, dos (2) dirigentes de cabildo y dos (2) comuneros. Los hallazgos de las opiniones expresadas permitieron describir los elementos teóricos - jurídicos del acceso a la justicia como derecho de los pueblos y nacionalidades indígenas; se identificaron los procedimientos de acceso a la justicia indígena y a la justicia ordinaria; se diseñó la guía de procedimiento para un adecuado acceso a la justicia, como un documento de apoyo y consulta para los operadores de justicia que conocen las causas. Se recomienda fortalecer a las instituciones que ofrecen servicios jurídicos gratuitos como la Defensoría Pública o consultorios jurídicos a partir de la difusión de información de sus propósitos, principalmente en zonas rurales en aspectos relevantes de esta temática.
Access to the justice emerges as one of the most important rights, whereby the general objective of the present study was to analyze the access to the justice as right for indigenous peoples and nationalities of Ecuador. The qualitative approach methodology and descriptive research were applied for developing the present study. A semi-structured interview including five (5) questions was applied to eight (8) participants: three (3) Judges, one (1) Public Prosecutor, two (2) Council Officers (2) and two (2) Communards. The findings obtained from the expressed views allowed describing the theoretical - legal elements of the access to the justice as right of indigenous peoples and nationalities; procedures of access to the indigenous and ordinary justice were identified; it was designed the procedure guideline for an appropriate access to the justice, as supporting and consultation document for the justice officials who know the causes. It’s recommended to strengthen to institutions that provide free legal services as Public Defender’s Offices or legal bureaus starting from the dissemination of information and their purposes, mainly in rural zones in relevant matters regarding this area
