Resumen
Dentro del Derecho Procesal Penal existen circunstancias particulares que pueden justificar el carácter antijurídico o de culpabilidad en el cometimiento de un delito, constituyendo eximentes de responsabilidad; esta circunstancia permitió plantear como objetivo general en esta investigación analizar el momento procesal de juzgar las causales de exclusión de la antijuricidad como son la legítima defensa, el estado de necesidad, el cumplimiento de una orden legítima y expresa de autoridad competente y el cumplimiento de un deber legal, haciendo énfasis al ejercicio legítimo del derecho a la defensa en casos de violencia de género contra la mujer. Aporte científico que puede ser utilizado tanto por operadores de justicia, como por titulares de ejercicio público de la acción penal incluso los abogados de la defensa, en las diferentes audiencias como forma de proteger a la mujer verdadera víctima que equívocamente está procesada por una mala apreciación del sistema de justicia penal y así permitir que la mujer se defienda en libertad ambulatoria y al final obtenga el sobreseimiento o la ratificatoria de inocencia. Fue necesario aplicar la metodología requerida consistente en un enfoque cualitativo, con un nivel de investigación descriptiva, con los métodos socio jurídico, deductivo y el analítico sintético, con el uso de las técnicas de revisión documental y de entrevistas con preguntas estructuradas; obteniendo como resultado que las causas de exclusión de la antijuridicidad de la conducta típica deben ser observadas en todo momento procesal sobre todo, la legítima defensa en los casos de violencia de género contra la mujer, erigiéndose como eximente de responsabilidad penal al rechazar una agresión actual e ilegítima, por un medio proporcional a la agresión recibida.
Within Criminal Procedural Law there are particular circumstances that can justify the unlawful nature or guilt in the commission of a crime, constituting defenses of responsibility; This circumstance allowed us to propose as a general objective in this investigation to analyze the procedural moment of judging the causes of exclusion of illegality such as self-defense, the state of necessity, compliance with a legitimate and express order of a competent authority and compliance with a legal duty, emphasizing the legitimate exercise of the right to defense in cases of gender violence against women. Scientific contribution that can be used both by justice operators, as well as by public exercise holders of criminal action, including defense lawyers, in the different hearings as a way to protect the true female victim who is mistakenly prosecuted for a misjudgment. of the criminal justice system and thus allow the woman to defend herself on freedom of movement and in the end obtain a dismissal or confirmation of innocence. It was necessary to apply the required methodology consisting of a qualitative approach, with a level of descriptive research, with socio-legal, deductive and analytical-synthetic methods, with the use of documentary review techniques and interviews with structured questions; As a result, the causes of exclusion of the illegality of typical conduct must be observed at all procedural moments, especially legitimate defense in cases of gender violence against women, establishing itself as an exemption from criminal responsibility when rejecting a current aggression. and illegitimate, by a means proportional to the aggression received.
