Resumen
El objetivo general de esta investigación es determinar los parámetros jurídicos que fundamentaron la decisión de la Corte Constitucional sobre el derecho colectivo a las tierras comunitarias de la comuna Tunibamba de Bellavista en la sentencia No. 2-14-EI/21. En este contexto, la pregunta central que se formula es: ¿Cuáles son los elementos jurídicos que fundamentan la decisión de la Corte Constitucional sobre el derecho colectivo a las tierras comunitarias de la comunidad de Tunibamba de Bellavista en la sentencia No. 2-14-EI/21? En este contexto, se resalta el análisis realizado por la Corte Constitucional, que concluyó que la decisión de la Asamblea comunal fracciono a la tierra comunitaria entre un reducido grupo de miembros infringía la garantía constitucional de indivisibilidad. En el capítulo inicial, se establece el marco teórico, normativo y jurisprudencial que fundamenta los procesos de expropiación, casos emblemáticos, los derechos colectivos, la administración de justicia indígena, así como los tratados y convenios internacionales relacionados con los pueblos y nacionalidades indígenas del Ecuador en la protección y desarrollo de los territorios ancestrales bajo la administración de la justicia indígena. . El segundo capítulo detalla cuáles son los elementos jurídicos que fundamentan la decisión de la Corte Constitucional sobre el derecho colectivo a las tierras comunitarias de la comuna de Tunibamba de Bellavista en la sentencia No. 2-14-EI/21. Finalmente el tercer capítulo se determinar la percepción de los moradores de la comunidad de Tunibamba sobre la aplicación de los parámetros jurídicos que fundamentan la decisión de la Corte Constitucional en la Sentencia No. 2-14-EI/21. En la cual se detallará los desafíos que se han presentado dentro de la comunidad, así como si la Sentencia se ha llegado a efectivizar de forma material y que garantías constitucionales se implementarían en el caso de que no se haya efectivizado
The general objective of this research is to determine the legal parameters that supported the Constitutional Court's decision on the collective right to communal lands of the Tunibamba de Bellavista commune in Judgment No. 2-14-EI/21. In this context, the central question posed is: What are the legal elements that support the Constitutional Court's decision on the collective right to communal lands of the Tunibamba de Bellavista community in Judgment No. 2-14-EI/21? In this context, the analysis carried out by the Constitutional Court is highlighted, which concluded that the decision of the Communal Assembly to divide the communal land among a small group of members violated the constitutional guarantee of indivisibility. The initial chapter establishes the theoretical, normative, and jurisprudential framework that underpins expropriation processes, emblematic cases, collective rights, the administration of Indigenous justice, as well as international treaties and conventions related to the protection and development of ancestral territories under the administration of Indigenous justice by Indigenous peoples and nationalities of Ecuador. The second chapter details the legal elements that underline the Constitutional Court's decision on the collective right to communal lands in the commune of Tunibamba de Bellavista in Judgment No. 2-14-EI/21. Finally, the third chapter examines the perception of the residents of the Tunibamba community regarding the application of the legal parameters that underlie the Constitutional Court's decision in Judgment No. 2- 14-EI/21. The report will detail the challenges that have arisen within the community, as well as whether the ruling has been materially implemented, and what constitutional guarantees would be implemented if they were not implemented.
