La reparación integral como política de Estado en los delitos de Violación.

Abstract

Identificar la situación actual de la RI-SPDV en adelante “reparación integral -como derecho- del sujeto perjudicado por el delito dañoso de violación sexual con violencia” en la etapa anterior o posterior a la sentencia judicial entendida como justicia restaurativa de reparación o de ‘‘RI-SPDV integral’’. Siendo que la problemática se relaciona con las inadecuadas ‘medidas que garanticen’ un adecuado resarcimiento de las víctimas. La metodología utilizada mixta con la utilización de métodos cuantitativos y cualitativos basados en la técnica cualitativa del cuestionario y las estadísticas nacionales emitidas por el Consejo de la Judicatura de corte cuantitativo. Siendo que los datos plasmados en la presente investigación dieron como resultado incidencias que deben ser mejoradas a la hora de garantizar el resarcimiento integral de la violación propiciada por los victimarios de RI-SPDV.

The data collected in this research resulted in incidences that should be improved in order to guarantee full compensation for the violation of the RI-SPDV by the perpetrators.
