El Delito de Terrorismo: un estudio crítico acerca de su aplicación en el Sistema Penal Ecuatoriano.

Resumen
Este artículo científico analizó el delito de terrorismo en el contexto del sistema penal ecuatoriano, centró su estudio en determinar si es adecuada y proporcional su aplicación considerando especialmente la ambigüedad, indeterminación, oscuridad y confusión que rodea a su estructura y tipificación, más aún cuando en el ámbito actual que vive el Ecuador se trata de imponer esta figura penal como medio coercitivo para sancionar el actuar de bandas delictivas, estas características han conducido a la vulneración de importantes principios procesales en el ámbito del Derecho Penal. En esta investigación, se adoptó un enfoque cualitativo que permite una exploración en profundidad de la complejidad jurídica y social que rodea al delito de terrorismo y su aplicación. El método analítico se empleó como marco metodológico, brindando las herramientas necesarias para descomponer tanto la terminología terrorismo, como la de bandas delictivas estableciendo sus diferencias, se analizó sus implicaciones y se evaluó sus consecuencias en el sistema legal y en la sociedad en general. Como solución ante esta problemática, se propuso una reforma en el artículo 366 del Código Orgánico Integral Penal. Esta reforma busca abordar las deficiencias identificadas en la tipificación del delito de terrorismo, enfocándose en la eliminación de ambigüedades y en la definición precisa de los elementos constitutivos del delito. Al hacerlo, se pretende garantizar una aplicación más coherente, justa y acorde con los principios fundamentales del sistema de justicia penal.
This scientific article analyzed the crime of terrorism in the context of the Ecuadorian criminal system, focused its study on determining whether its application is adequate and proportional, especially considering the ambiguity, indeterminacy, obscurity and confusion surrounding its structure and typification, even more so when in the current environment that Ecuador lives, it is trying to impose this criminal figure as a coercive means to punish the actions of criminal gangs, these characteristics have led to the violation of important procedural principles in the field of criminal law. In this research, a qualitative approach was adopted to allow an in-depth exploration of the legal and social complexity surrounding the crime of terrorism and its application. The analytical method was used as a methodological framework, providing the necessary tools to break down both the terminology of terrorism and that of criminal gangs, establishing their differences, analyzing their implications and evaluating their consequences in the legal system and in society in general. As a solution to this problem, a reform of article 366 of the Organic Integral Penal Code was proposed. This reform seeks to address the deficiencies identified in the classification of the crime of terrorism, focusing on the elimination of ambiguities and the precise definition of the constituent elements of the crime. In doing so, it is intended to ensure a more consistent, fair and fair application in accordance with the fundamental principles of the criminal justice system.
