Resumen
El artículo centró su análisis en el acceso a la justicia y la tutela judicial efectiva en el delito de femicidio en el Ecuador. El poder punitivo del Estado tiene por potestad constitucional la creación de leyes e instituciones represivas cuya función primordial se enfoca en la protección de los derechos de los ciudadanos; en ello, además el acceso a la justicia y tutela judicial efectiva dentro de los procesos penales la cual garantice su efectivo cumplimiento más aún aquellas víctimas que reflejan actos de violencia contra las mujeres. La metodología empleada tuvo un enfoque cualitativo, cuyo nivel de investigación es descriptivo, de tipo documental y bibliográfico empleando para su efecto el método exegético jurídico, con el objetivo de la recolección y procesamiento de la información se utilizó la técnica de la revisión documental los cuales permitieron aproximarse con objetividad al tema planteado, cuyo resultado da a conocimiento la importancia de aquellos derechos para lograr una justa sanción sobre la acciones cometidas en contra de la vida de las mujeres, con un adecuado proceso revestido de las garantías básicas del debido proceso conllevando así que los procedimientos sean justos para los sujetos procesales. Finalmente, se concluye que si bien el acceso a la justicia como la tutela judicial efectiva se encuentra descrito como derechos constitucionales en muchos de los casos en la práctica judicial se han visto menoscabados estos preceptos dejando en la indefensión a los sujetos procesales
The article focused its analysis on access to justice and effective judicial protection in the crime of femicide in Ecuador. The punitive power of the State has the constitutional power to create laws and repressive institutions whose primary function is focused on the protection of the rights of citizens; in addition, access to justice and effective judicial protection in criminal proceedings which guarantees their effective compliance, especially for those victims who reflect acts of violence against women. The methodology used had a qualitative approach, whose level of research is descriptive, documentary and bibliographic type using for its effect the legal exegetical method, with the objective of the collection and processing of the information the technique of the documentary review was used which allowed to approach with objectivity to the raised subject, The result of which reveals the importance of those rights to achieve a just sanction on the actions committed against women's lives, with an adequate process covered by the basic guarantees of due process, thus making the procedures fair for the procedural subjects. Finally, it is concluded that although access to justice and effective judicial protection are described as constitutional rights, in many cases in judicial practice these precepts have been undermined, leaving women defenseless.
