Delito de Receptación Aduanera en Ecuador: tensión jurídica con Eficacia Procesal Penal, Principio de Inocencia, Debido Proceso y Tutela Judicial Efectiva.

Resumen
El presente trabajo de investigación respondió a la situación problemática sobre la tensión jurídica existente entre el delito de receptación aduanera con la eficacia procesal penal y principios de presunción de inocencia, tutela judicial efectiva, debido proceso; la pregunta del problema fue: ¿Existe tensión jurídica entre el delito de receptación aduanera y la eficacia procesal penal, además de garantías constitucionales como principio de inocencia, debido proceso y tutela judicial efectiva?, la idea a defender es: el delito de Receptación Aduanera enmarcado en el artículo 300 del Código Orgánico Integral Penal presenta en su redacción particularidades que se contraponen a la eficacia del proceso penal y garantías constitucionales como principio de inocencia, debido proceso y tutela judicial efectiva. El objetivo general fue Analizar los elementos constitutivos del delito de receptación aduanera que tensionan con la eficacia procesal penal; principios de inocencia, debido proceso y tutela judicial efectiva; la metodología utilizada: enfoque de la investigación a aplicar: cualitativo, así como el tipo de investigación: documental y bibliográfico, junto al método analítico, la técnica es la revisión bibliográfica. Como conclusiones se destaca que el delito de receptación aduanera tensiona con diferentes principios procesales al momento de una incorrecta aplicación en cuanto al plazo de justificación de origen licito de la mercancía extranjera previo al inicio de la acción penal. Como recomendaciones la necesidad de establecer protocolos específicos para la investigación de delitos aduaneros, que incorporen expresamente los principios procesales, enfatizando que la falta de documentación no equivale automáticamente a culpabilidad.
This research work responded to the problematic situation regarding the existing legal tension between the crime of customs receiving and the criminal procedural effectiveness and principles of presumption of innocence, effective judicial protection, due process; The problem question was: Is there legal tension between the crime of customs receiving and criminal procedural effectiveness, in addition to constitutional guarantees such as the principle of innocence, due process and effective judicial protection? The idea to be defended is: the crime of Customs Receiving framed in article 300 of the Comprehensive Organic Criminal Code presents in its wording particularities that contradict the effectiveness of the criminal process and constitutional guarantees such as the principle of innocence, due process and effective judicial protection. The general objective was to analyze the constituent elements of the crime of customs receiving that tension with criminal procedural effectiveness; principles of innocence, due process and effective judicial protection; the methodology used: qualitative research approach to be applied, as well as the type of research: documentary and bibliographic, along with the methods: analytical-synthetic, the technique is the documentary review. As conclusions, it is highlighted that the crime of customs receiving conflicts with different procedural principles when it is incorrectly applied regarding the period of justification of the lawful origin of foreign merchandise prior to the initiation of criminal action. As recommendations, the need to establish specific protocols for the investigation of customs crimes, which expressly incorporate procedural principles, emphasizing that the lack of documentation does not automatically equate to guilt
