Resumen
Este trabajo de investigación con el tema “FALTA DE MOTIVACIÓN EN LA PRISIÓN PREVENTIVA VULNERA LA PRESUNCIÓN DE INOCENCIA”, es un estudio de la
prisión preventiva desde el ámbito jurídico; el objetivo general fue analizar la falta de motivación en la prisión preventiva vulnera la presunción de inocencia. Para su desarrollo se aplicó una metodología con enfoque cualitativo y una investigación de tipo descriptiva-documental. Se empleó la técnica de entrevista estructurada por seis (6) preguntas, aplicada a seis (6) participantes: 2 Jueces del Tribunal de Garantías Penales de Imbabura, dos (2) Jueces de la Unidad Judicial Penal de primera instancia y dos (2) Abogados. Los resultados de las opiniones expresadas permitieron llegar a la conclusión que, como medida, no es la regla general al momento de aplicar las medidas cautelares personales para asegurar su comparecencia en el proceso, no obstante, para asegurar el juzgamiento penal, y para poder garantizarle a la víctima su reparación integral, esta medida cautelar personal es aplicada de forma innecesaria; por lo tanto, se recomienda exhortar a los Fiscales, que tomen en cuenta la solicitud de la aplicación de otro tipo de medidas, como el grillete electrónico, acompañado de la prohibición de salida del país y de la presentación en cada cierto tiempo ante su autoridad, observando la prueba necesaria que realmente conduzcan a la participación de individuo en el hecho investigado, y que se tome en cuenta los efectos perjudiciales del encarcelamiento.
This research work with the theme "LACK OF MOTIVATION IN PRISON PREVENTIVE VIOLATES THE PRESUMPTION OF INNOCENCE”, is a study of preventive detention from the legal field; the general objective was to analyze the lack of motivation in preventive detention violates the presumption of innocence. For its development, a methodology with a qualitative approach and descriptive-documentary research was applied. The interview technique structured by six (6) questions was used, applied to six (6) participants: 2 Judges of the Court of Criminal Guarantees of Imbabura, two (2) Judges of the Criminal Judicial Unit of first instance and two (2) Lawyers. The results of the opinions expressed allowed us to conclude that, as a measure, it is not the general rule when applying personal precautionary measures to ensure their appearance in the process, however, to ensure criminal prosecution, and to be able to guarantee full reparation to the victim, this personal precautionary measure is applied unnecessarily; therefore, it is recommended to exhort the Prosecutors to take into account the request for the application of other types of measures, such as the electronic shackle, accompanied by the prohibition of leaving the country and the presentation from time to time before their authority. , observing the necessary evidence that really leads to the participation of the individual in the investigated fact, and that the harmful effects of imprisonment are taken into account.
