Resumen
“La Ineficacia de la Acción de Repetición en el Ordenamiento Jurídico Ecuatoriano”. Trabajo para optar al título de magister en Derecho Constitucional. Programa en Maestría de Derecho Constitucional- Tercera Cohorte. Otavalo, Imbabura, Ecuador, 2021. La investigación con el tema “La Ineficacia de la Acción de Repetición en el Ordenamiento Jurídico Ecuatoriano”, tuvo como objetivo general explicar la ineficacia de la acción de repetición, a fin de determinar, si los funcionarios públicos en el accionar de sus funciones, han actuado con dolo o culpa grave. Para el desarrollo se utilizó una metodología cualitativa y una investigación de tipo descriptivo documental y jurídico. Se aplicó una entrevista semi-estructurada contentiva de ocho preguntas aplicada a seis participantes, todas funcionarias de la Procuraduría General del Estado. Los hallazgos de las opiniones expresadas permitieron concluir que existen vacíos legales que atentan contra la armonía y congruencia en la normativa vigente, así como, la vulneración al principio a la seguridad jurídica por existir varios cuerpos normativos, por lo que se recomienda exhortar a la Corte Constitucional del Ecuador, siente un precedente judicial respecto a la existencia de varios mecanismos de ejecución de la acción de repetición, pues, la existente normativa mantiene una insuficiente carga argumentativa que conlleva a confusión.
“The Ineffectiveness of the Action of Repetition in the Ecuadorian Legal System”. Work to qualify for the title of Master in Constitutional Law. Master's Program in Constitutional Law - Third Cohort. Otavalo, Imbabura, Ecuador, 2021. The research with the theme "The Ineffectiveness of the Action of Repetition in the Ecuadorian Legal System", had as general objective to explain the ineffectiveness of the action of repetition, in order to determine, if public officials in the actions of their functions, have acted with intent or gross negligence. For the development, a qualitative methodology and a documentary and legal descriptive investigation were used. A semi-structured interview containing five questions was applied to six participants, all officials of the State Attorney General's Office. The findings of the opinions expressed allowed us to conclude that there are legal gaps that threaten the harmony and consistency in the current regulations, as well as the violation of legal certainty at the beginning due to the existence of several regulatory bodies, for which it is recommended to exhort the Court Constitutional Law of Ecuador, sets a judicial precedent regarding the existence of several mechanisms for the execution of the repetition action, since the existing regulations maintain an insufficient argumentative load that leads to confusion.
