Resumen
La admisión del hecho punible por parte del procesado como requisito sine cuanon en la aplicación del procedimiento abreviado, en relación con el derecho humano la no
autoincriminación, se ha convertido en un punto controvertido dentro del sistema procesal penal, al considerar que este proceso de negociación entre la fiscalía y el procesado no es siempre libre y voluntario.
El procedimiento abreviado al estar normado en el Art. 635 del Código Orgánico Integral Penal, tiene como fin terminar el proceso judicial antes de llegar a la etapa de juicio oral; sin embargo, la norma constitucional a través del Art. 77 numeral 7, literal c) prohíbe la autoincriminación, sosteniendo que nadie puede ser forzado a declarar en contra de sí mismo; de ahí que, se prohíbe todo tipo de coacción física, moral o psíquica. A través de la aplicación del método analítico y jurídico, bajo una técnica documental y de entrevistas, se ha podido determinar que en la aplicación del procedimiento abreviado, se debe precautelar el debido proceso y sobre todo la no autoincriminación del procesado; labor que recae en la fiscalía, el abogado defensor del procesado y por el juez, este último debe garantizar que el procesado no se auto incrimine y que los elementos de convicción obtenidos por fiscalía no vulneren derechos tanto del procesado como de la víctima.
The admission of the punishable act by the defendant as a sinecuanon requirement in the application of the abbreviated procedure, in relation to the human right to non-self incrimination, has become a controversial point within the criminal.rocedure system, considering that this process of negotiation between the prosecution and the defendant is not always free and voluntary. The abbreviated procedure, being regulated in Article 635 of the Organic Integral Criminal Code, aims to finish the judicial process before reaching the oral trial stage; however, the constitutional norm through Art. 77 numeral 7, literal c) prohibits self-incrimination, maintaining that no one can be forced to testify against himself; hence, all kinds of physical, moral or mental coercion are prohibited.Through the application of the analytical and legal method, under a documentary and interview technique, it has been determined that in the application of the abbreviated procedure, due process must be safeguarded and, above all, the non-self-incrimination of the accused; The work that falls on the prosecution, the defendant's defense lawyer and the judge, the latter must ensure that the defendant does not incriminate himself and that the elements of conviction obtained by the prosecution do not violate the rights of both the defendant and the victim.
