Resumen
El presente trabajo de investigación respondió a la situación problemática sobre el alcance de la responsabilidad subjetiva del empleador en los accidentes laborales en el Ecuador por lo cual, la pregunta del problema fue: ¿Cuál es la tipificación de la responsabilidad subjetiva del empleador frente a los accidentes laborales en Ecuador? El objetivo general fue analizar la responsabilidad subjetiva del empleador en los accidentes laborales en Ecuador, la metodología utilizada: enfoque de la investigación a aplicar: cualitativo, así como el tipo de investigación: documental y dogmática jurídica, junto a los métodos: Análisis Sistemático, la técnica es la revisión documental. Como conclusiones se destaca que la existencia de una problemática por la insuficiencia de normas jurídicas en derecho laboral en el Ecuador, debido a que dentro de la normativa laboral no se expresa la existencia de la responsabilidad subjetiva que se presentará en caso de los accidentes laborales, mientras que el Código Civil a pesar de ser una norma suplementaria no cubren de manera explícita de como procederá en dichos casos, por ende al no presentarse de una forma tasita dentro del Código Laboral se puede llegar a una interpretación amplia la cual pude ser de manera positiva o negativa para los trabajadores. Como recomendaciones el Estado debe efectuar acciones como agregar a la legislación vigente e incorporar nuevas normas y reglas concernientes a la materia en un Código de Trabajo.
ABSTRAC The present research work responded to the problematic situation regarding the scope of the employer's subjective responsibility in work accidents in Ecuador, therefore, the problem question was: What is the normative adequacy of the employer's subjective responsibility against work accidents in Ecuador? The general objective was to analyse the subjective responsibility of the employer in workplace accidents in Ecuador, the methodology used: research approach to be applied: qualitative, as well as the type of research: documentary and legal dogmatic, along with the methods: Systematic Analysis, the technique is documentary review. As conclusions, it is highlighted that the existence of a problem due to the insufficiency of legal standards in labour law in Ecuador, due to the fact that within the labour regulations the existence of subjective responsibility that will arise in the case of work accidents is not expressed, while the Civil Code, despite being a supplementary norm, does not explicitly cover how it will proceed in such cases, therefore, by not presenting it in a limited way within the Labour Code, a broad interpretation can be reached which could be positive or negative for workers. As recommendations, the State must carry out actions such as adding to current legislation and incorporating new norms and rules concerning the matter in a Labour Code.
