Derechos de la Fauna Marina en las Islas Galápagos: estrategias de conservación ante la crisis climática.

Resumen
El trabajo de investigación respondió al reconocimiento jurídico y las estrategias de conservación ambiental como principales mecanismos para tutelar los derechos de la fauna marina en las islas Galápagos; se centró, en el impacto de la crisis climática y cómo ésta afecta a los ecosistemas. La investigación, abordó la problemática sobre los mecanismos jurídicos especiales, que protegen a los ecosistemas de la fauna marina de las islas Galápagos y la forma en que estos pueden garantizar la biodiversidad; especialmente, al presentarse el aumento de la temperatura de océanos y mares, provocando vulnerabilidad en las distintas especies al colocar en riesgo a animales marinos emblemáticos como la tortuga marina y el pingüino de Galápagos. La investigación es del tipo documental con enfoque cualitativo, dogmático-jurídico, desarrollado con el análisis de la normativa nacional e internacional, estudios científicos y revisión de políticas públicas ambientales. Los resultados indicaron que, aunque la Constitución y la normativa nacional reconoce los derechos de la naturaleza, la tutela que es referente a la fauna marina solo depende de los planes estratégicos institucionales y referente a las políticas públicas para fortalecerlas y que estas se adapten ante el cambio climático. Se concluyo, que no existe normativa específica que determine directamente a los derechos de la fauna marina ante la crisis climática; por lo cual, se precisa generar planes estratégicos que ayuden a aplicar el Plan Estratégico para el Desarrollo de la Economía azul en Galápagos y el Plan Estratégico Institucional de la Dirección del Parque Nacional Galápagos.
The investigative work responded to legal reconnaissance and environmental conservation strategies as main mechanisms to protect the rights of marine fauna on the Galápagos islands; focus on the impact of the climate crisis and how it affects ecosystems. The investigation addressed the issue of special legal mechanisms that protect the marine fauna ecosystems of the Galápagos Islands and the way in which they can guarantee biodiversity; especially, due to the increase in the temperature of oceans and seas, causing vulnerability in different species and putting at risk emblematic marine animals such as the tortuga marina and the Galápagos penguin. The investigation is of a documentary type with a qualitative, dogmatic- legal focus, developed with the analysis of national and international regulations, scientific studies and review of environmental public policies. The results indicate that, even though the Constitution and national regulations recognize natural rights, the protection that concerns marine fauna only depends on institutional strategic plans and public policies to strengthen them and adapt them to climate change. In conclusion, there is no specific regulation that directly determines the rights of marine fauna before the climate crisis; Therefore, it is necessary to generate strategic plans that help to apply the Strategic Plan for the Development of the Blue Economy in the Galápagos and the Institutional Strategic Plan for the Management of the Galápagos National Park.
