Resumen
El presente artículo de alto nivel ha tenido como objetivo principal determinar los factores principales que han afectado el cumplimiento de la rehabilitación, a través, de la
educación, en el Centro de Privación de Libertad de Imbabura, en el período marzo-agosto del 2020, en razón de que en este ámbito temporal se promulgaron medidas para mitigar la emergencia sanitaria causada por covid-19, declarando desde la Presidencia de la república el estado de excepción y un conjunto de medidas, limitando así la libre movilidad, con su restricción total de las actividades sociales y económicas. Para efectuar este análisis se ha empleado la metodología desde la dimensión empírica, basada en el enfoque cualitativo, por medio del análisis e identificación de los postulamos doctrinales y normativos que se encuentran inmersos en esta controversia formulada, dando lugar a la investigación descriptiva, aplicando las técnicas de revisión documental y la entrevista, mismas que permitieron establecer que el acceso a la educación es un derecho fundamental que se encuentra contemplado en los instrumentos internacionales de derechos humanos y en la le1gislación nacional, especialmente de los Ppl, al constituirse como un grupo vulnerable de atención prioritario, puesto que, en la esfera constitucional son catalogados como un grupo vulnerable de atención prioritaria. Concluyendo así, en la premisa de que efectivamente se comprometió el derecho a la educación en Centro de Privación de
Libertad de Imbabura, por medio de la declaración de emergencia con el estado de excepción emitido por la presidencia de la república, limitando el libre tránsito por medio del decreto 1017, contrariando el artículo 12, numeral 4 del COIP, invisibilizando el cumplimiento de este derecho.
The main objective of this high-level article has been to determine the main factors that have affected compliance with rehabilitation, through education, in the Imbabura Deprivation of Liberty Center, in the period March-August 2020, because in this temporary area measures were enacted to reduce the health emergency caused by covid-19, declaring from the Presidency of the Republic a state of emergency and a set of measures, thus limiting free mobility, with its total restriction of social and economic activities. To carry out this analysis, the methodology has been used from the empirical dimension, based on the qualitative approach, through the analysis and identification of the doctrinal, theoretical and normative postulates that are immersed in this formulated controversy, giving rise to explanatory research, applying the techniques of documentary review and the interview, the same ones that allowed establishing that access to education is a fundamental right that is contemplated in international human rights instruments and in national legislation, especially of the Ppl, when constituting themselves as a vulnerable group of priority attention, since, in the constitutional sphere, they are classified as a vulnerable group of priority attention. Concluding thus, on the premise that the right to education was effectively compromised in the Imbabura Deprivation of Liberty Center, through the declaration of emergency with the state of exception issued by the presidency of the republic, limiting free transit through through decree 1017, contrary to article 12, numeral 4 of the COIP, making the fulfillment of this right invisible.
