Resumen
La reparación integral en el Ecuador es considerada como un fragmento de la consecuencia jurídica para el procesado de una infracción, además, de ser un mecanismo que permite a la víctima el lograr una recuperación de los derechos que se le hayan violentado, restituyéndolos de manera económica mediante indemnización, en forma de recuperación física, psicológica, o dignificante mediante disculpas públicas, entre otras medidas; dejando en claro sobre la importancia de asegurar el cumplimiento de este mecanismo de reparación.
El objetivo dentro del presente trabajo representa el análisis al marco legal de la reparación integral en el Ecuador, además de evaluar la situación actual de implementación, propone recomendaciones enfocadas en la efectividad de los mecanismos de reparación y garantizar
el pleno ejercicio de los derechos de las víctimas.
Dentro de los resultados obtenidos mediante la realización de la investigación de la literatura se pudo comprobar que Ecuador cuenta con la normativa necesaria para la implementación de la reparación integral, tanto nacional como internacional; además, se determinó que los jueces cuentan con suficientes elementos, tanto normativa, doctrina y jurisprudencia
necesaria para justificar sus decisiones y emitir las correspondientes sanciones y
reparaciones correspondientes, determinándolas en remuneraciones económicas o en
restituciones más simbólicas; y finalmente el encontrar la falta de un mecanismo de control
en referencia al cumplimiento de sentencias, relacionado a la vulneración de derechos de las
víctimas por insolvencia delsentenciado, falta de celeridad en los procesos e incumplimiento
de medidas restitutivas de los derechos simbólicos, vulneran aún más los derechos
constitucionales de las víctimas a las que se busca restituir.
In Ecuador, comprehensive reparation is considered as part of the legal consequence for the prosecution of an offense. Additionally, it serves as a mechanism that enables the victim to achieve recovery of rights that may have been violated, restoring them economically through compensation and in forms such as physical, psychological, or dignifying recovery, including public apologies, among other measures. This emphasizes the importance of ensuring compliance with this reparative mechanism. The objective within the present work represents the analysis of the legal framework of comprehensive reparation in Ecuador, in addition to evaluating the current situation of implementation, it proposes recommendations focused on the effectiveness of reparation mechanisms and guaranteeing the full exercise of the rights of victims. Within the results obtained by carrying out the literature research, it was possible to verifythat Ecuador has the necessary regulations for the implementation of comprehensive reparation, both national and international; Furthermore, it was determined that the judges have sufficient elements, both regulations, doctrine and jurisprudence necessary to justify their decisions and issue the corresponding sanctions and reparations, determining them in economic remunerations or in more symbolic restitutions; and finally finding the lack of a control mechanism in reference to compliance with sentences, related to the violation of victims' rights due to insolvency of the sentenced person, lack of speed in the processes and non-compliance with restorative measures of symbolic rights, still violate plus the constitutional rights of the victims to whom restitution is sought.
