Resumen
La presente investigación está enfocada en el estudio de las garantías constitucionales de la no aplicaciones la privación de la libertad como regla general, la autodeterminación de los pueblos indígenas, teniendo como objetivo determinar la pertinencia de la prisión preventiva en personas autoidentificadas indígenas, en particular las que integran pueblos de contacto reciente.
Partiendo del análisis de la Sentencia No. 112-14-JH/21 de Habeas Corpus, emitido por el Pleno de la Corte Constitucional del Ecuador en el año 2021, en el que se individualiza sobre la vulneración de los derechos constitucionales de libertad e integridad personal, de personas autoidentificadas como indígenas, de los pueblos conocidos como waorani y taromenane que se describen como un grupo indígena de contacto inicial miembros de estos grupos encontraban privados de la libertad, sin considerar las características antropológicas propias de las personas, que se encuentran en “aislamiento voluntario” hasta antes de su detención en noviembre del 2013, y que su primer contacto con la sociedad moderna fue la cárcel.
This research is focused on the study of the constitutional guarantees of non-application of the deprivation of liberty as a general rule, the self-determination of indigenous peoples, with the objective of determining the relevance of pretrial detention for selfidentified indigenous persons, particularly those who are part of recently-contacted peoples. Based on the analysis of Judgment No. 112-14-JH/21 of Habeas No. 112-14-JH/21 of Habeas No. 112-14-JH/21. 112-14-JH/21 of Habeas Corpus, issued by the Plenary of the Constitutional Court of Ecuador in the year 2021, which individualizes on the violation of the constitutional rights of freedom and personal integrity, of persons self-identified as indigenous, of the peoples known as Waorani and Taromenane who are described as an indigenous group of initial contact members of these groups were deprived of liberty, without considering the anthropological characteristics of the people, who are in "voluntary isolation" until before their arrest in November 2013, and that their first contact with modern society was the prison.
