Resumen
La relación entre la imprescriptibilidad de los delitos y el debido proceso es compleja y controvertida. Por un lado, la imprescriptibilidad busca garantizar el acceso a la justicia para las víctimas, permitiéndoles perseguir a sus agresores sin importar el tiempo que haya pasado desde el hecho. Por otro lado, puede entrar en conflicto con el debido proceso, que es un conjunto de garantías que protegen a los acusados de ser procesados Por ello, el presente estudio plantea como objetivo analizar la imprescriptibilidad del delito de violación en niños niñas y adolescentes frente al principio de presunción de inocencia del debido proceso. La metodología planteada fue de enfoque cualitativo, de nivel descriptivo, utilizando como instrumento, una guía de entrevista. Los resultados indican que la no prescripción de la acción penal por violación contra menores no vulnera los derechos de los acusados, puesto que no implica una acusación automática, aunque permite al Estado enjuiciar a los agresores sin limitaciones temporales. Sin embargo, resulta necesario mejorar los procesos del sistema judicial para no depender exclusivamente de la no prescripción, asegurar una justicia rápida para las víctimas. Paralelamente, se debe reforzar las medidas para salvaguardar la privacidad de las víctimas, así como invertir en la capacitación del personal que maneja estos casos. Los jueces han evidenciado su compromiso con la justicia al rechazar apelaciones basadas en la prescripción y al reconocer a las víctimas como grupos vulnerables que requieren protección especial.
The link between crime imprescriptibly and due process is a complex and controversial issue. Firstable, imprescriptibility seeks to guarantee access to justice for victims, allowing them to pursue their aggressors regardless of the time that has passed since the incident. On the other hand, it may occur a conflict with due process, based upon a set of guarantees that could protect the accused from being prosecuted. Therefore, the aim of this research is to analyze the rape crime imprescriptibly in children and teenagers against the principle of innocense presumption of due process. The methodology was a qualitative approach, at a descriptive level, using interview guide as an instrument. The results has shown the non-prescription of criminal action for rape against minors does not violate the rights of the accused, since it does not imply an automatic accusation, although it allows the State to prosecute the aggressors without time limitations. However, it is necessary to improve the processes of the judicial system so as not to depend exclusively on non-prescription, to ensure quick justice for the victims. At the same time, measures to safeguard the privacy of victims must be reinforced, as well as investing in the training of personnel who handle these cases. Judges have demonstrated their commitment to justice by rejecting appeals based on the statute of limitations and by recognizing victims as vulnerable groups that require special protection.
