Resumen
La legislación ecuatoriana ha sido unánime al reconocer el arbitraje, la conciliación, la mediación y otros procedimientos alternativos para la resolución de conflictos, en varias materias, pero, particularmente en materia penal, proporcionando al proceso penal ecuatoriano numerosas ventajas. Esto contribuyó a que el objetivo general de esta investigación consistiera en analizar la conciliación como medio alternativo de solución de conflictos, en relación a los fines específicos de la pena, en los delitos de acción privada, para evidenciar su utilidad en la praxis judicial. Para el logro del este cometido se empleó el enfoque cualitativo, con una profundidad descriptivo-documental, debido a que se detallaron las características fundamentales de la audiencia de conciliación en su aplicación en los delitos de acción privada, y se recurrió al método socio-jurídico y al lógico deductivo, con técnicas de investigación necesarias para validar los resultados como la revisión documental y la entrevista, que permitieron obtener diversas perspectivas sobre este constructo jurídico. Esta nueva forma de administrar justicia, que erige a la conciliación como alternativa de solución de conflictos privados, con una visión más humana, busca en realidad satisfacer a los afectados y apartarse paulatinamente de condenar a los imputados, dentro de una justicia punitiva obsoleta que privaba de la libertad a cualquier persona, de manera desmedida, sin necesidad de recurrir al Ministerio Público, sino directamente ante un juez de Garantías Penales y proporcionando los elementos necesarios para el impulso procesal de la causa. Pudiendo concluir que se ha establecido de manera firme dentro del proceso penal ecuatoriano y liberando de tanta carga laboral a los tribunales ordinarios.
Ecuadorian legislation has been unanimous in recognizing arbitration, conciliation, mediation and other alternative procedures for conflict resolution, in various matters, but particularly in criminal matters, providing the Ecuadorian criminal process with numerous advantages. This contributed to the general objective of this research being to analyze conciliation as an alternative means of conflict resolution, in relation to the specific purposes of the sentence, in crimes of private action, to demonstrate its usefulness in judicial praxis. To achieve this goal, the qualitative approach was used, with a descriptive-documentary depth, due to the fact that the fundamental characteristics of the conciliation hearing were detailed in its application in crimes of private action, and the socio-legal method was used. and to the deductive logic, with research techniques necessary to validate the results such as documentary review and interview, which allowed obtaining different perspectives on this legal construct. This new way of administering justice, which establishes conciliation as an alternative for the solution of private conflicts, with a more humane vision, actually seeks to satisfy those affected and gradually move away from convicting the accused, within an obsolete punitive justice that deprived freedom to any person, in an excessive way, without the need to resort to the Public Ministry, but directly before a judge of Criminal Guarantees and providing the necessary elements for the procedural promotion of the case. Being able to conclude that it has been firmly established within the Ecuadorian criminal process and freeing the ordinary courts from so much workload.
