Resumen
El presente trabajo tiene la finalidad de analizar a profundidad el derecho constitucional del acceso gratuito a la justicia en cuanto al pago de peritajes en el ejercicio privado de la acción penal en Ecuador, derecho que involucra a todas las personas a tener las posibilidades de acceder a un sistema judicial y asistencia jurídica, de manera gratuita, es decir sin costos elevados o limitaciones financieras que obstaculicen el alcance a la justicia. Pues, el acceso gratuito a la justicia, reconocido y establecido en el artículo 75 de la Constitución de la República del Ecuador, determina que: “toda persona tiene derecho al acceso gratuito a la justicia y a obtener una tutela efectiva, imparcial y expedita”, entendiendo que este derecho es suma importancia para lograr la igualdad frente a la ley, y para proteger los derechos y libertades individuales y colectivas. No obstante, en el Ecuador, este derecho constitucional se ve muy afectado en la realidad social, debido a que no se efectiviza ni aplica al momento de exigir el pago, a las personas afectadas, para la realización de peritajes en el ejercicio privado de la acción penal. En cuanto a la metodología del trabajo se ha aplicado el método explicativo.
The purpose of this paper is to analyze in depth the constitutional right of Free Access to Justice regarding the Payment of Experts in the Private Exercise of Criminal Action in Ecuador, a right that involves all persons to have the possibility of accessing a judicial system and legal assistance, free of charge, i.e., without high costs or financial limitations that hinder access to justice. Free access to justice, recognized and established in Article 75 of the Constitution of the Republic of Ecuador, determines that: "everyone has the right to free access to justice and to obtain effective, impartial and expeditious protection", understanding that this right is of utmost importance to achieve equality before the law, and to protect individual and collective rights and freedoms. However, in Ecuador, this constitutional right is greatly affected in the social reality, because it is not effective or applied at the time of demanding payment to the affected persons for the realization of expert opinions in the private exercise of criminal action. As for the methodology of the work, the explanatory method has been applied.
