La posible vulneración del Derecho a la defensa dentro del Procedimiento Directo en el Derecho Penal Ecuatoriano.

Resumen
Este proyecto está encaminado a realizar un breve análisis relativo al procedimiento directo, caracterizándose en casos de delitos flagrantes que conlleva a resolver al Juez en una sola audiencia, dentro de los veinte días, entre otras características del procedimiento directo, así como también es necesario conocer su procedencia partiendo de la normativa nacional e internacional, delitos que están tipificados por el Código Orgánico Integral Penal. Por otro lado, también tenemos los principios aplicables al debido proceso y respeto de las garantías constitucionales, si bien este procedimiento ha logrado procesar diferentes trámites que se encontraban sin resolver aplicando su propósito inicial sean ágiles y rápidos para la solución de un conflicto. De igual manera tenemos el derecho a la defensa que establece nuestra Constitución de la República del Ecuador y que guarda relación con diferentes normativas legales ecuatorianas, y que deben de ser respetadas dentro de un juicio. Es así que, esta investigación se desarrolló bajo un marco normativo y doctrinario en donde se toma en consideración el procedimiento directo, el debido proceso y el derecho a la defensa. Posteriormente, se procede a un análisis de sentencias y encuestas con ayuda de la información recopilada, concluyendo con la determinación de las violaciones del derecho a la defensa que toman lugar en la aplicación práctica del procedimiento directo. Los resultados de este trabajo se espera que se demuestre claramente el procedimiento adecuado dentro de la litis y se especifique los delitos sancionados en contra de la propiedad
This project is aimed at carrying out a brief analysis related to the direct procedure, characterizing itself in cases of flagrant crimes and leading to resolve the Judge in a single hearing, within twenty days, among other characteristics of the direct procedure, as well as it is also necessary to know their origin based on national and international regulations and these crimes must be typified by the Organic Comprehensive Criminal Code. On the other hand, we also have the principles applicable to due process and respect for constitutional guarantees, although this procedure has managed to process different procedures that were unresolved, applying its initial purpose to be agile and quick for the solution of a conflict. In the same way we have the right to defense established by our Constitution of the Republic of Ecuador and that is related to different Ecuadorian legal regulations, and that must be respected in a trial. Thus, this research was developed under a normative and doctrinal framework where the direct procedure, due process and the right to defense are taken into consideration. Subsequently, we proceed to an analysis of sentences and surveys with the help of the information gathered, concluding with the determination of the violations of the right to defense that take place in the practical application of the direct procedure. The results of this work are expected to clearly demonstrate the proper procedure within the litis and to specify the punishable crimes against property
