Resumen
El trabajo que se presenta a continuación tiene como objetivo general determinar si la esquizofrenia como trastorno mental es una causa de imputabilidad dentro del sistema penal ecuatoriano, por medio del análisis de la norma y las fuentes doctrinarias, siendo así necesario determinar los factores que conllevaron al cometimiento del hecho y la correcta aplicación de las medidas de seguridad por parte de los juzgadores. Dentro del Estado, ha sido evidente la necesidad de crear normativa que se adapte a los cambios constantes de la sociedad, si bien es cierto, los trastornos mentales han sido conocidos y estudiados desde la antigüedad, estos han tomado un papel relevante dentro del Derecho Penal Ecuatoriano desde su tipificación dentro de la normativa, por lo que es importante conocer y analizar el procedimiento a emplearse ante quien ha transgredido la norma padeciendo un trastorno mental, con la finalidad de crear lineamientos que permitan establecer de forma clara las condiciones que deberá presentar el sujeto activo para determinar si este es o no inimputable, garantizando así medidas de seguridad acordes a sus padecimientos y a futuro la reinserción social.
The work presented below has the general objective of determining whether schizophrenia as a mental disorder is a cause of imputability within the Ecuadorian penal system, through the analysis of the norm and the doctrinal sources, thus being necessary to determine the factors that led to the commission of the act and the correct application of security measures by the judges. Within the State, the need to create regulations that adapt to the constant changes in society has been evident, although it is true, mental disorders have been known and studied since ancient times, they have played an important role within Criminal Law Ecuadorian since its typification within the regulations, so it is important to know and analyze the procedure to be used before those who have transgressed the norm suffering from a mental disorder, in order to create guidelines that allow to clearly establish the conditions that the active subject to determine whether or not he is not imputable, thus guaranteeing security measures in accordance with his sufferings and in the future social reintegration.
