Resumen
El objetivo principal de la presente investigación es proponer la implementación en la legislación ecuatoriana, de la figura jurídica de custodia compartida a través de una reforma al actual Código Orgánico de la Niñez y Adolescencia. Es necesario cambiar la perspectiva y el modo de aplicar las normas y leyes establecidas que manejamos actualmente respecto a la custodia unilateral, que se otorga a uno solo de los progenitores. La aplicabilidad de leyes se enfoca hacia un sentido legalista sin tomar en cuenta el verdadero interés superior del Niño, Niña y Adolescente, que, a lo largo de estos años, ha demostrado que la custodia uniparental no es la mejor opción para su correcto desarrollo afecto-emocional. En relación a la metodología, se utilizará un enfoque cuali-cuantitativo donde se obtendrán resultados que respaldan esta teoría, la cual pretende demostrar que la custodia compartida es una opción viable que fomenta tanto el desarrollo integral de los niños, niñas y adolescentes, como el respeto al derecho de igualdad y no discriminación que tienen sus progenitores, esta problemática ataca directamente a una situación en concreto como es la inexistencia de esta figura jurídica en la legislación ecuatoriana. Se realizarán encuestas y entrevistas en relación a la custodia compartida a progenitores divorciados y a distintos profesionales especializados en el tema. Por medio de esta investigación, se plantea otorgar la custodia de los niños, niñas y adolescentes de manera igualitaria hacia ambos progenitores, siempre que se cumplan determinados requisitos detallados y desarrollados en la parte pertinente del artículo.
ABSTRACT The main objective of this research is to propose the implementation in Ecuadorian legislation of the legal figure of shared custody through a reform to the current Organic Code of Children and Adolescence. It is necessary to change the perspective and the way of applying the established rules and laws that we currently manage regarding unilateral custody, which is granted to only one of the parents. The applicability of laws is focused towards a legalistic sense without taking into account the true best interest of the Child and Adolescent, who, throughout these years, has demonstrated that single-parent custody is not the best option for their correct emotional development. -emotional. Surveys and interviews will be carried out in relation to shared custody with divorced parents and with different professionals specialized in the subject. Through this research, it is proposed to grant custody of children and adolescents equally to both parents, provided that certain detailed requirements developed in the relevant part of the article are met.
