La mediación obligatoria como medio de solución de conflictos en materia de contratación pública

Resumen
La Constitución ecuatoriana reconoce al arbitraje como método alternativo para solucionar conflictos en materia de contratación pública. Para optar por el arbitraje se requiere de la aprobación previa de la Procuraduría General del Estado. Desde el año 2021, el SERCOP exige la mediación como paso previo al arbitraje o para iniciar un proceso judicial ya que este tipo de conflictos, traen consecuencias desfavorables como gastos administrativos innecesarios, resoluciones postergadas o procesos inconclusos, entre otros. El objetivo de esta investigación es analizar la mediación obligatoria como medio de solución de conflictos en materia de contratación pública. Metodológicamente, esta investigación aborda la mediación obligatoria en contratación pública desde una perspectiva cualitativa, enfocándose en la calidad de la información disponible, utilizando el nivel descriptivo de investigación para analizar eficientemente la documentación sobre mediación obligatoria. El método analítico se emplea para demostrar la importancia y necesidad de la mediación obligatoria; además se aplica el método histórico para examinar la evolución de la mediación obligatoria en legislaciones internacionales y sus ventajas económicas y procesales; sumadas la investigación documental que respalda la importancia de lo tratado. Este trabajo investigativo plantea una propuesta para reducir problemas en materia contratación pública relacionados al incumplimiento de pagos y anticipos, contratiempos en la compra y entrega de bienes o servicios a través del reconocimiento de la mediación obligatoria en procesos de contratación pública, considerando que la mediación voluntaria presenta varias desventajas en esta materia. Este reconocimiento permitiría además agilizar resoluciones, evitar litigios costosos y reducir gastos al erario público.
ABSTRACT The Ecuadorian Constitution recognizes arbitration as an alternative method for resolving disputes in public procurement matters. To opt for arbitration, prior approval from the Attorney General's Office is required. Since 2021, SERCOP (the Public Procurement Regulatory Agency) has mandate mediation as a preliminary step to arbitration or initiating a legal process. This is because these types of conflicts can result in unfavorable consequences such as unnecessary administrative expenses, delayed resolutions, or unfinished processes, among others. The objective of this research is to analyze mandatory mediation as a means of resolving public procurement conflicts. Methodologically, this investigation approaches mandatory mediation in public procurement from a qualitative perspective, focusing on the quality of available information. It uses a descriptive level of research to efficiently analyze documentation on mandatory mediation. The analytical method is employed to demonstrate the importance and necessity of mandatory mediation; additionally, the historical method is applied to examine the evolution of mandatory mediation in international legislations and its economic and procedural advantages, this is complemented by documentary research that supports the importance of the topic. This investigative work proposes a solution to reduce problems related to non-payment, advances, and delays in the purchase and delivery of goods or services in public procurement. This consideration arises from the fact that voluntary mediation presents several disadvantages in this context. Such recognition would further expedite resolutions, prevent costly litigation, and reduce expenses for the public treasury.
