Análisis del principio de confianza: su importancia, Aplicación e incorporación en la codificación penal ecuatoriana para delitos flagrantes

Resumen
El propósito de esta investigación radica en identificar y demostrar la efectividad del principio de confianza en los procedimientos relacionados con delitos flagrantes, con el fin de garantizar una defensa jurídica ágil y oportuna. Además, se abordará la problemática vinculada a la ineficiencia y falta de protección judicial efectiva, así como la aplicación insuficiente de principios y derechos en los procesos de delitos flagrantes, lo que contribuye al deterioro del sistema penitenciario ecuatoriano. En términos metodológicos, se empleó un enfoque explicativo para analizar la interpretación y aplicación del Principio de Confianza en el desarrollo de los procesos penales durante las audiencias de calificación de flagrancia en la Unidad Judicial Multicompetente San Jacinto de Yaguachi. Esta investigación resalta la importancia de fortalecer el principio de confianza en los procesos penales y en la defensa jurídica de los implicados, abogando por su integración en la legislación penal ecuatoriana. Además, destaca la necesidad de diferenciar claramente la responsabilidad penal de los participantes en un acto delictivo, con el objetivo de garantizar un procedimiento legal ágil y eficaz en beneficio del servicio ciudadano. En consecuencia, se sugiere la implementación de medidas que permitan la individualización de la persona procesada y su responsabilidad en el delito al comparecer a una audiencia de formulación de cargos, asegurando así una demostración justificada del grado de autoría y participación,
conforme a los distintos niveles de implicación de cada individuo, dentro del marco
normativo de nuestra codificación penal.
ABSTRACT: The purpose of this research is to identify and demonstrate the effectiveness of the principle of trust in proceedings related to flagrante delicto, in order to guarantee an agile and timely legal defense. In addition, the problems related to the inefficiency and lack of effective judicial protection, as well as the insufficient application of principles and rights in the prosecution of flagrante delicto, which contributes to the deterioration of the Ecuadorian prison system, will be addressed. In methodological terms, an explanatory approach was used to analyze the interpretation and application of the Principle of Trust in the development of criminal proceedings during flagrante delicto hearings in the San Jacinto de Yaguachi Multicompetent Judicial Unit. This research highlights the importance of strengthening the principle of trust in criminal proceedings and in the legal defense of those involved, advocating for its integration into Ecuadorian criminal law. In addition, it highlights the need to clearly differentiate the criminal liability of participants in a criminalact, with the aim of ensuring an agile and effective legal procedure for the benefit of citizen service. Consequently, it is suggested that measures be implemented to identify theaccused person and his or her responsibility for the crime when he or she appears at a hearing to formulate charges, thus ensuring a justified demonstration of the degree of authorship and participation, in accordance with the different levels of involvement of each individual, within the normative framework of our criminal code.
