Resumen
La presente investigación está orientada a realizar un análisis jurídico sobre la pensión alimenticia y su restitución en casos de paternidad ilegítima y/o falsa en el
Ecuador, para lo cual se analizó fuentes normativas como la Constitución de la República del Ecuador, Código Civil y Código de la Niñez y Adolescencia. Utilizando una
metodología con enfoque cualitativo, de tipología aplicada y descriptiva mediante la aplicación de un cuestionario estructurado (entrevista); posterior a ello la revisión
documental en base al derecho comparado. Donde se pudo verificar por parte de los abogados y jueces consultados, coincidencias relativas a la novedad del tema y su complejidad; puesto que en el caso del Ecuador, el concepto de paternidad no está bien desarrollado en la legislación, por lo que es fundamental analizar los factores sociales y culturales que influyen en la paternidad y el reconocimiento de los hijos; donde se sugiere la necesidad de impulsar reformas legales para abordar la coparentalidad y la tenencia compartida, respaldadas por pruebas médicas validadas. Concluyendo que el abuso del derecho en la falsa imputación de la paternidad es un problema complejo que afecta a las personas implicadas, tanto en términos legales como emocionales y aunque según el derecho comparado hay similitudes en cuanto a la obligación de ambos padres de proporcionar alimentos y las posibles sanciones por incumplimiento en varios países; existe un vacío legal que aún no se subsana para establecer el procedimiento y parámetros normativos necesarios que eviten esta problemática.
ABSTRACT/KEYWORDS The present investigation is aimed at carrying out a legal analysis on alimony and its restitution in cases of illegitimate and/or false paternity in Ecuador, for which normative sources were analyzed such as the Constitution of the Republic of Ecuador, Civil Code and Code of Childhood and Adolescence. Using a methodology with a qualitative approach, applied and descriptive typology through the application of a structured questionnaire (interview); After that, the documentary review based on comparative law. Where it was possible to verify by the lawyers and judges consulted, coincidences regarding the novelty of the topic and its complexity; since in the case of Ecuador, the concept of paternity is not well developed in the legislation, so it is essential to analyze the social and cultural factors that influence paternity and the recognition of children; where the need to promote legal reforms to address coparenting and shared custody is suggested, supported by validated medical evidence. Concluding that the abuse of the right in the false imputation of paternity is a complex problem that affects the people involved, both in legal and emotional terms and although according to comparative law there are similarities regarding the obligation of both parents to provide food and possible sanctions for non-compliance in various countries; There is a legal vacuum that has not yet been corrected to establish the necessary procedure and regulatory parameters to avoid this problem.
