Resumen
El presente informe de investigación tiene como objetivo general analizar la evolución y eficacia de la mediación como método alternativo de solución de conflictos en el Ecuador. Actualmente existe una problemática relacionada con la congestión de los sistemas judiciales tradicionales, porque han venido demostrando ser lentos e ineficientes y esto hace necesario buscar la aplicación de métodos alternativos como la mediación. En la investigación se utilizó un enfoque cualitativo, revisando fuentes primarias y secundarias, incluyendo legislación y jurisprudencia, también se realizó un estudio documental y estadístico sobre la evolución de la mediación en el Ecuador, analizando datos e informes oficiales. Los resultados muestran que la mediación se ha ido implementando progresivamente en el Ecuador, especialmente en materias que se pueden transigir, lo que ha permitido agilizar la solución de conflictos, aunque existen aún retos como la falta de conocimiento y cultura de paz. Ya que la mediación se ha ido consolidando como método alternativo desde su regulación en la LAM. Sin embargo, todavía falta mayor difusión y capacitación para su adecuada implementación. En conclusión, la mediación se presenta como un método eficaz para complementar el sistema judicial ecuatoriano, siempre y cuando se mejore su implementación y se promueva su uso entre la ciudadanía. A pesar de los avances, se requiere mayor inversión estatal, capacitación de mediadores e información a la ciudadanía para lograr una mayor eficacia de la mediación como método alternativo de resolución de conflictos en el Ecuador.
ABSTRACT This research report has the general objective of analyzing the evolution and effectiveness of mediation as an alternative method of conflict resolution in Ecuador. Currently, there is a problem related to the congestion of traditional judicial systems, because they have been proving to be slow and inefficient and this makes it necessary to seek the application of alternative methods such as mediation. In the research, a qualitative approach was used, reviewing primary and secondary sources, including legislation and jurisprudence, a documentary and statistical study was also carried out on the evolution of mediation in Ecuador, analyzing data and official reports. The results show that mediation has been progressively implemented in Ecuador, especially in matters that can be compromised, which has made it possible to expedite the resolution of conflicts, although there are still challenges such as the lack of knowledge and culture of peace. Since mediation has been consolidated as an alternative method since its regulation in the LAM. However, there is still a need for greater dissemination and training for its proper implementation. In conclusion, mediation is presented as an effective method to complement the Ecuadorian judicial system, as long as its implementation is improved and its use among citizens is promoted. That despite the advances, greater state investment, training of mediators and information to citizens are required to achieve greater effectiveness of mediation as an alternative method of conflict resolution in Ecuador.
