Resumen
Al Estado ecuatoriano se lo reconoció como intercultural y plurinacional, debido a la existencia de varias culturas, entre ellas a las nacionalidades indígenas, las cuales tienen su forma de organización administrativa y jurisdiccional definida. Esta investigación tuvo como objetivo el estudio de los términos intercultural, plurinacional, pluralismo jurídico y acceso a la justicia ancestral lo cual demostró que la justicia indígena puede ejercerse aplicando sus costumbres. A través de la metodología en la que se realizó un enfoque cualitativo, se empleó el método analítico crítico para analizar la sentencia No. 113-14-SEP-CC denominado caso “La Cocha” con la cual se descubrió las violaciones constitucionales al artículo 57 numeral 10 de la norma suprema que reconoció el ejercicio de crear, desarrollar, aplicar y practicar su derecho consuetudinario y luego de una investigación no experimental, descriptiva, documental y aplicada se logró precisar los alcances de esta sentencia, aspectos negativos que generaron en el ejercicio de la justicia indígena, esto es, de impedir que puedan juzgar los delitos contra la vida, se concluyó que los limites afectan hasta la actualidad el derecho de autodeterminación de los pueblos y nacionalidad indígenas, la autonomía en su forma de ejercer su justicia, y finalmente se dejó determinado que la norma constitucional protege la existencia del pluralismo jurídico por lo que el único límite valido que puede restringir el ejercicio de la justicia indígena es el respeto de los derechos humanos y de la norma constitucional.
Abstract The Ecuadorian State was recognized as intercultural and multinational, due to the existence of several cultures, among them the indigenous nationalities, which have their defined form of administrative and jurisdictional organization. This research aimed to study the terms, intercultural, multinational, legal pluralism and access to ancestral justice, wich showed that indigenous justice can be exercised by applying their customs. Through the methodology in which a qualitative approach was carried out, the critical analytical method was used to analyze sentence No. 113-14-SEP CC called the “La Cocha” case, with which the constitutional violations of article 57 were discovered numeral 10 of the supreme norm that recognized the exercise of creating, developing, applying an practicing its customary law and after a non experimental, descriptive, documentary and applied investigation, it was possible to specify the scope of this sentence, negative aspects that generated in the exercise of indigenous justice, that is, to prevent them from prosecuting crimes against life, it concluded that the limits still affect the right to self-determination of indigenous peoples and nationalities, autonomy in the way they exercise their justice, and finally It was determined that the constitucional rule protects the existences of legal pluralism, so the only valid limit that can restrict the axis the principle of indigenous justice is respect for human rights and constitucional norms.
