El hábeas corpus correctivo como garantía jurisdiccional para evitar los tratos crueles e inhumanos en las personas privadas de la libertad

Resumen
La investigación aborda el Hábeas Corpus correctivo como garantía jurisdiccional para evitar los tratos crueles e inhumanos en las personas privadas de la libertad, con la finalidad de describir Hábeas Corpus correctivo como Garantía Jurisdiccional para evitar los tratos crueles e inhumanos en las personas privadas de la libertad, mediante el método cualitativo y cuantitativo, La investigación es cualitativa en razón que se presenta un caso práctico, que se analiza y se demuestra cómo afecta las garantías básicas del debido proceso que incluye el derecho a la libertad y el principio de Habeas Corpus. En el enfoque cuantitativo se realizó el levantamiento de información de la totalidad de sentencias comprendidas en el periodo entre 01 de junio de 2022 a 01 de diciembre de 2022, de aquellas acciones de Habeas Corpus propuestas en los diferentes niveles jurisdiccionales de la provincia de Pichincha, además, se realizó una encuesta a 148 jueces de Pichincha de quienes se recabo información sobre en conocimiento de esta acción. Concluyendo que desde la perspectiva de los jueces encuestados la acción de Habeas Corpus correctivo si representa una Jurisdiccional para evitar los tratos crueles e inhumanos en las personas privadas de la libertad, por otro lado, en referencia con los casos estudiados se establece que los procedimientos, acciones y resoluciones consideradas, pese a no ser las adecuadas, garantizan la protección integral de las PPL facultando así un proceso accesible y ágil, sin embargo, hay que tener en consideración los procesos reglados para efectuar un procesamiento justo, integro y de calidad. De esta manera con la información recaba de los
casos presentados en la investigación se concluye que no existe vulneración de derecho de las PPL en el pedido de acción de la garantía jurisdiccional de habeas corpus
ABSTRACT The research addresses the corrective Habeas Corpus as a jurisdictional guarantee to prevent cruel and inhuman treatment of persons deprived of liberty, with the purpose of describe the corrective Habeas Corpus as a jurisdictional guarantee to prevent cruel and inhuman treatment of persons deprived of liberty, The research is qualitative because it presents a practical case, which is analyzed and demonstrates how it affects the basic guarantees of due process that includes the right to liberty and the principle of Habeas Corpus. In the quantitative approach, information was gathered from the totality of sentences from June 1, 2022 to December 1, 2022, of those Habeas Corpus actions proposed in the different jurisdictional levels of the province of Pichincha, in addition, a survey was made to 148 judges of Pichincha from whom information was gathered on the knowledge of this action. It was concluded that from the perspective of the judges surveyed, the corrective Habeas Corpus action does represent a jurisdictional measure to avoid cruel and inhumane treatment of persons deprived of liberty. On the other hand, in reference to the cases studied, it was established that the procedures, actions and resolutions considered, despite not being adequate, guarantee the integral protection of the PPL, thus enabling an accessible and agile process; however, the regulated processes must be taken into consideration to carry out a fair, integral and quality process. Thus, with the information gathered from the cases presented in the investigation, it is concluded that there is no violation of the rights of the PPL in the request for action of the jurisdictional guarantee of habeas corpus.
