Resumen
La presente investigación se ha enfocado en analizar los procedimientos de mediaciones en tres centros de mediación del Cantón Otavalo, evidenciándose un alto índice de casos que no han logrado solucionar sus conflictos o que han llegado a acuerdos parciales. El objetivo de este trabajo investigativo, es analizar los modelos de solución de conflictos utilizados en los centros de mediación de Otavalo. La metodología de la presente investigación efectúa un enfoque cualitativo, al basarse en un análisis del desarrollo de las audiencias de mediación; tiene un nivel descriptivo porque recopila datos de los centros de mediación del Cantón Otavalo; se han empleado los métodos histórico y documental, que han permitido analizar datos históricos de la mediación en el Ecuador y recabar información respecto a los modelos o métodos de solución de conflictos utilizados en la mediación, aplicando una investigación de campo y la técnica de la entrevista. Esta investigación ha analizado tres modelos de solución de conflictos que son: Modelo o Método de Harvard, Circular Narrativo y el Transformativo, los cuales constituyen herramientas indispensables para resolver controversias, de acuerdo a las características que presenta cada conflicto. Por esta razón se concluye que es indispensable reconocer y normar la aplicación de estos modelos de solución de conflictos en los centros de mediación del Cantón Otavalo, con el fin de que las audiencias concluyan en acuerdos para las partes, promoviendo a la mediación como un método efectivo para solucionar conflictos de forma extrajudicial.
ABSTRACT The present investigation has focused on analyzing the mediation procedures in three mediation centers in the Otavalo Canton, evidencing a high rate of cases that have not been able to resolve their conflicts or that have reached partial agreements. The objective of this investigative work is to analyze the conflict resolution models used in the mediation centers of Otavalo. The methodology of this research carries out a qualitative approach, based on an analysis of the development of mediation audiences; It has a descriptive level because it collects data from the mediation centers of the Otavalo Canton; Historical and documentary methods have been used, which have allowed us to analyze historical data on mediation in Ecuador and gather information regarding the models or methods of conflict resolution used in mediation, applying field research and the interview technique. This research has analyzed three models of conflict resolution that are: the Harvard Model or Method, Narrative Circular and Transformative, which are essential tools to resolve disputes, according to the characteristics of each conflict. For this reason, it is concluded that it is essential to recognize and regulate the application of these conflict resolution models in the mediation centers of the Otavalo Canton, so that the hearings conclude in agreements for the parties, promoting mediation as a method Effective to resolve disputes out of court.
