Resumen
Este trabajo de investigación presenta a la naturaleza como sujeto procesal en el procedimiento sancionador previsto en el Código Orgánico del Ambiente del Ecuador
(CODA), fundamentado en la teoría critica ambiental latinoamericana; el objetivo general, fue analizar las implicaciones procesales que genera la naturaleza como sujeto procesal dentro del procedimiento sancionador. Para ello, se utilizó una metodología del tipo documental dogmática jurídica, que permitió analizar cualitativamente las diferentes instituciones jurídicas expresadas en las resoluciones constitucionales en materia administrativa a estudiarse, así como la normativa vinculada a la aplicación de un procedimiento surgido de la potestad sancionadora ante infracciones administrativas ambientales desde el marco jurídico, la doctrina y jurisprudencia de la Corte Constitucional del Ecuador. En este contexto, se conjugación el derecho procesal, constitucional, ambiental y de la naturaleza a través de un desarrollo teórico jurídico aplicable al procedimiento administrativo sancionador, ello requirió la revisión de instituciones como: la condición de parte o sujeto procesal, la legitimación, la jurisdicción, el debido proceso, al juez natural, la teoría de la prueba, la sentencia y su necesaria motivación, a través de la argumentación jurídica. Se obtuvieron como conclusiones que el otorgar derechos a animales, ríos, bosques y ecosistemas implica reconocer su valor intrínseco, más allá de su utilidad para el ser humano, significa repensar el desarrollo desde una ética ecocéntrica que integre las necesidades de todos los componentes del ambiente natural con enfoque intercultural que invada el ámbito administrativo dentro de la potestas sancionadora del Estado ecuatoriano.
Abstract This research work presents nature as a procedural subject in the sanctioning procedure provided for in the Organic Code of the Environment of Ecuador (CODA), based on Latin American critical environmental theory; The general objective was to analyze the procedural implications generated by nature as a procedural subject within the sanctioning procedure. To do this, a legal dogmatic documentary type methodology was used, which allowed for a qualitative analysis of the different legal institutions expressed in the constitutional resolutions on administrative matters to be studied, as well as the regulations linked to the application of a procedure arising from the power to sanction infringements. environmental administrative actions from the legal framework, doctrine and jurisprudence of the Constitutional Court of Ecuador. In this context, procedural, constitutional, environmental and nature law was combined through a legal theoretical development applicable to the administrative sanctioning procedure, this required the review of institutions such as: the condition of party or procedural subject, legitimation, jurisdiction, due process, the natural judge, the theory of evidence, the sentence and its necessary motivation, through legal argumentation. Conclusions were obtained that granting rights to animals, rivers, forests, and ecosystems implies recognizing their intrinsic value, beyond their usefulness for human beings, it means rethinking development from an ecocentric ethic that integrates the needs of all components of the environment. natural with an intercultural approach that invades the administrative sphere within the sanctioning powers of the Ecuadorian State.
