La Interseccionalidad de la Discriminación: una Herramienta Analítica en la Vulneración de Derechos Humanos.

Resumen
El presente informe de investigación tuvo el objetivo de investigar la pertinencia y utilidad de la aplicación de la interseccionalidad de la discriminación, y la teoría de la interseccionalidad como una herramienta analítica en la vulneración de derechos humanos. Se visibilizó como problema de investigación, la utilización de un análisis con perspectiva unidimensional con la cual abordan la interseccionalidad, analizando cada factor de vulnerabilidad de manera aislada, como fenómenos independientes, sin comprender la convergencia de diferentes ejes de discriminación, que han producido formas específicas de vulneración de derechos humanos. En este sentido, se mantuvo como objetivo general, investigar el desarrollo teórico-conceptual de la interseccionalidad y su aplicación en el análisis de la vulneración de derechos humanos. Además, para alcanzar este objetivo, se desagregaron tres objetivos específicos que partieron con, identificar la convergencia entre la interseccionalidad y los derechos humanos, reconocer la jurisprudencia relevante de la Corte IDH y el TEDH acerca de la interseccionalidad y la discriminación, y explicar la pertinencia de la interseccionalidad en la jurisprudencia de la Corte Constitucional del Ecuador. Se usó como piedra angular para abordar toda la investigación, el método analítico y el método deductivo, con el uso de un enfoque cualitativo, a través del uso de técnicas de revisión de doctrina, sentencias e investigaciones relacionadas con el objeto de investigación. No obstante, con este desarrollo investigativo, se visibilizó el enfoque específico y particular de la interseccionalidad y la discriminación, la ausencia de enfoques interseccionales preventivos a través del análisis de jurisprudencia y la necesidad de un mayor desarrollo jurídico de la interseccionalidad y los derechos humanos.
This research report aimed to investigate the relevance and usefulness of applying the intersectionality of discrimination and intersectionality Theory as an analytical tool in human rights violations. The research problem identified was the use of a one-dimensional approach to intersectionality, which analyzes each vulnerability factor in isolation, as independent phenomena, without understanding the convergence of different axes of discrimination that have produced specific forms of human rights violations. Therefore, the overall objective was to investigate the theoretical and conceptual development of intersectionality and its application in the analysis of human rights violations. Furthermore, to achieve this objective, three specific objectives were developed: identifying the convergence between Intersectionality and human rights; recognizing the relevant jurisprudence of the Inter-American Court of Human Rights and the European Court of Human Rights regarding intersectionality and discrimination; and explaining the relevance of intersectionality in the jurisprudence of the Constitutional Court of Ecuador. The analytical and deductive methods were used as the cornerstone of the entire research, employing a qualitative approach through the use of techniques such as reviewing legal doctrine, judgments, and research related to the research topic. However, this research process highlighted the specific and particular approach to Intersectionality and discrimination, the absence of preventive intersectional approaches through jurisprudential analysis, and the need for further legal development of intersectionality and human rights.
