Resumen
El presente artículo se centra en la complejidad que rodea el despacho y la resolución de los juicios ejecutivos, considerando la extensión del procedimiento legalmente establecido por cuanto inicia con la presentación de la demanda, la debida notificación a la contraparte, el embargo de sus bienes, remate y al final el pago al acreedor, de esta forma existe una carga laboral de las dependencias judiciales. Por ende, se aborda la necesidad de gestionar el tiempo y los recursos de manera eficiente en estos trámites. Para lograr este objetivo, se utiliza una modalidad mixta que incluye enfoques cuantitativos y cualitativos, junto con métodos descriptivos, analíticos y dogmáticos. En particular, se emplea la técnica de entrevistar a profesionales del derecho en diversas ocupaciones dentro del ámbito legal. Los resultados de esta investigación y el análisis crítico de la teoría existente sugieren una solución en forma de un Proyecto de Ley reformatorio al Código Orgánico General de Procesos, que propone la implementación de una Audiencia de Mediación como paso previo al juicio. El propósito de esta propuesta es optimizar el desarrollo procesal y agilizar los procedimientos legales. Además, busca mejorar la atención a usuarios y garantizar sus derechos. Esta reforma representa una respuesta efectiva a la necesidad apremiante de mejorar la eficiencia del sistema judicial y aliviar la carga de trabajo en las dependencias judiciales, por medio de la voluntad de las partes, tanto del deudor como para proponer la mediación en el momento de la contestación, como del actor para aceptarla.
ABSTRACT The present article focuses on the complexity surrounding the dispatch and resolution of executive lawsuits, considering the length of the legally established procedure and the workload of judicial departments. It addresses the need to manage time and resources efficiently in these procedures. To achieve this objective, a mixed modality is used, including quantitative and qualitative approaches, along with descriptive, analytical, and dogmatic methods. In particular, the technique of interviewing legal professionals in various occupations within the legal field is employed. The results of this research and the critical analysis of existing theory suggest a solution in the form of a reform bill to the General Organic Code of Procedures. This reform proposes the implementation of a Mediation Hearing as a prerequisite to Executive Lawsuits. The purpose of this proposal is to optimize procedural development, contribute to the judicial system, and expedite legal procedures. Furthermore, it aims to improve user service and safeguard their rights. This reform represents an effective response to the pressing need to enhance the efficiency of the judicial system and alleviate the workload in judicial departments. In summary, the implementation of the Mediation Hearing prior to Executive Lawsuits appears as a valuable measure that can benefit all parties involved in the legal process.
