Resumen
La mediación laboral previa puede constituir una herramienta relevante para la solución de los conflictos individuales de trabajo, sin embargo, al momento de su aplicación, se presentan una serie de limitaciones que dificultan su utilización, debido a que en la normativa vigente hay vacíos respecto a la observancia del principio de irrenunciabilidad de los derechos de los trabajadores, la negociación real, la transacción, la determinación de los temas transigibles, entre otros aspectos. El objetivo general de la presente investigación es analizar la aplicación de la mediación previa en los conflictos individuales de trabajo, para determinar la importancia de su reconocimiento partiendo de la praxis. Metodológicamente la investigación es de enfoque cualitativo y nivel descriptivo. Se desarrolla dentro de los métodos analítico y dogmático, contando para ello, con una investigación de tipo documental y a su vez de campo, empleando como técnica de recolección de datos las entrevistas focus group, realizadas a servidores públicos del Ministerio del Trabajo del Cantón Cuenca. En esta investigación se concluye que los Acuerdos Ministeriales MDT-2019-0157 y MDT2022-236 dictados por el Ministerio del Trabajo, contienen normativa que en algunos aspectos no es clara, lo que dificulta la aplicación de la mediación laboral previa en conflictos individuales de trabajo. Sin duda, la mediación laboral previa reviste de características especiales que la hacen distinta de cualquier otro tipo de mediación, pues en ella se debe hacer prevalecer los derechos de los trabajadores.
ABSTRACT Previous labor mediation can be a relevant tool for the solution of individual labor conflicts, however, at the time of its application, there are a series of limitations that make its use difficult, due to the fact that in current regulations there are gaps regarding the observance of the principle of inalienability of workers' rights, real negotiation, transaction, determination of compromise issues, among other aspects. The general objective of this research is to analyze the application of prior mediation in individual work conflicts, to determine the importance of its recognition based on praxis. Methodologically, the research has a qualitative approach and a descriptive level. It is developed within the analytical and dogmatic methods, counting for this, with documentary and field research, using focus group interviews as a data collection technique, carried out with public servants of the Ministry of Labor of the Cuenca Canton. This investigation concludes that the Ministerial Agreements MDT-2019-0157 and MDT-2022-236 issued by the Ministry of Labor contain regulations that are not clear in some aspects, which makes it difficult to apply prior labor mediation in individual conflicts of work. Undoubtedly, prior labor mediation has special characteristics that make it different from any other type of mediation, since in it the rights of workers must prevail.
