Resumen
La problemática del exceso de notificaciones en los procesos de liquidación de pensiones alimenticias adeudadas en Ecuador, analizando su impacto en los derechos de los niños, niñas y adolescentes. Mediante una metodología cualitativa basada en análisis documental, se examina el marco legal ecuatoriano, los procedimientos judiciales actuales y estudios recientes sobre el tema. Los hallazgos revelan que las notificaciones excesivas ocasionan retrasos significativos en el cumplimiento de las obligaciones alimenticias, perjudicando el bienestar de los menores. El análisis de casos muestra que el 78% de los procesos de liquidación experimentan retrasos debido a notificaciones repetitivas, con un promedio de 4.5 notificaciones por caso. Estos retrasos afectan directamente los derechos de los niños, niñas y adolescentes a una vida digna, educación y salud. El 65% de los hogares monoparentales que dependen de pensiones alimenticias reportan dificultades para cubrir gastos esenciales durante los períodos de retraso, mientras que el 40% de los niños, niñas y adolescentes en estas situaciones experimentan interrupciones en su educación. El estudio concluye que es necesario optimizar los procesos judiciales y fortalecer los mecanismos de cobranza para asegurar la protección efectiva de los derechos de los niños, niñas y adolescentes. Se recomienda implementar un sistema de notificación electrónica, simplificar el proceso de liquidación, y fortalecer los mecanismos de cobranza. Además, se sugiere capacitar al personal judicial sobre la importancia de los derechos de los niños, niñas y adolescentes y realizar una revisión integral del sistema de justicia familiar en Ecuador.
Abstract The issue of excessive notifications in the settlement processes of overdue child support payments in Ecuador is analyzed, focusing on its impact on the rights of children and adolescents. Using a qualitative methodology based on document analysis, the Ecuadorian legal framework, current judicial procedures, and recent studies on the topic are examined. Findings reveal that excessive notifications cause significant delays in fulfilling child support obligations, negatively affecting the well-being of minors. Case analysis shows that 78% of settlement processes experience delays due to repetitive notifications, with an average of 4.5 notifications per case. These delays directly impact children's rights to a dignified life, education, and health. Sixty-five percent of single-parent households dependent on child support report difficulties covering essential expenses during delay periods, while 40% of children and adolescents in these situations experience interruptions in their education. The study concludes that optimizing judicial processes and strengthening collection mechanisms are necessary to ensure the effective protection of children's rights. Recommendations include implementing an electronic notification system, simplifying the settlement process, and reinforcing collection mechanisms. Additionally, it is suggested to train judicial personnel on the importance of children's rights and conduct a comprehensive review of the family justice system in Ecuador.
