Resumen
La presente investigación sostuvo como objetivo general argumentar sobre el libre desarrollo de la personalidad de las niñas, niños y adolescentes con el razonamiento de sentencias recopiladas de los Boletines de la Corte Constitucional del Ecuador. De igual manera, la problemática que se describió en el presente trabajo es la inexistencia de formulaciones de líneas jurisprudenciales que permitan comprender cómo la Corte Constitucional interpreta y aplica el derecho al libre desarrollo de personalidad de las niñas, niños y adolescentes en juicios donde son protagonistas. En lo que respecta a la metodología se utilizó un enfoque cualitativo analizando casos o sentencias mediante la técnica de líneas jurisprudenciales construidas, elaboradas y propuestas por el Profesor Diego López Medina. Esta investigación dio como resultado el poder comprender la línea jurisprudencial que se aplica en las sentencias recopiladas de los Boletines de la Corte Constitucional del Ecuador para respetar el libre desarrollo de personalidad de las niñas, niños y adolescentes y estudiar la vulneración a este derecho en estas sentencias. En definitiva, se concluye que la edad no es un limitante para comparecer en un juicio en donde esté involucrado una niña, niño o adolescente quienes pueden expresarse con sensatez, estabilidad emocional y psicológica.
ABSTRACT The general objective of this research was to argue about the free development of the personality of children and adolescents with the reasoning of sentences compiled from the Bulletins of the Constitutional Court of Ecuador. Likewise, the problem described in this work is the inexistence of formulations of jurisprudential lines that allow understanding how the Constitutional Court interprets and applies the right to the free development of personality of children and adolescents in trials where they are protagonists. Regarding the methodology, a qualitative approach was used, analyzing cases or sentences through the technique of jurisprudential lines constructed, elaborated and proposed by Professor Diego López Medina. This research resulted in being able to understand the jurisprudential line applied in the sentences compiled from the Bulletins of the Constitutional Court of Ecuador to respect the free development of personality of children and adolescents and to study the violation of this right in these sentences. In short, it is concluded that age is not a limiting factor for appearing in a trial involving a child or adolescent who can express themselves sensibly and with emotional and psychological stability.
