Aplicación del régimen semiabierto en el delito de tráfico ilícito de sustancias catalogadas sujetas a fiscalización en alta escala y el principio de irretroactividad.

Resumen
El presente trabajo de investigación tuvo como objetivo general analizar la falta de aplicación del régimen semiabierto al sentenciado por el delito de tráfico ilícito de sustancias catalogadas sujetas a fiscalización en alta escala antes de la reforma al COIP, por parte de los jueces de garantías penitenciarias y analizar la existencia de vulneración del principio de irretroactividad de la ley. Con la promulgación y entrada en vigencia de la Ley Orgánica Reformatoria al Código Orgánico Integral Penal, se excluyen del acceso al régimen penitenciario semiabierto a las personas privadas de libertad que hayan sido condenadas por tráfico ilícito de sustancias catalogadas sujetas a fiscalización en alta escala, a más de otros tipos penales. Situación que al momento se encuentra siendo aplicada por algunos jueces de garantías penales, quienes tienen el encargo de las garantías penitenciarias, sin considerar que las personas sentenciadas por el delito de tráfico ilícito de sustancias catalogadas sujetas a fiscalización en alta escala fueron sentenciadas previo a la vigencia de esta exclusión, lo que vulneraría el principio de irretroactividad de la ley. Para ello se aplicó, el método inductivo-deductivo, método analítico sintético, método histórico lógico, las técnicas de estudio de casos particulares, la entrevista, el análisis de documentos y los instrumentos como fichas de datos sobre casos particulares, guía de entrevista. De los resultados obtenidos se puede destacar que en las solicitudes de acceso al régimen semiabierto presentado por las personas privadas de libertad que hayan sido condenadas por tráfico ilícito de sustancias catalogadas sujetas a fiscalización en alta escala, se está aplicando la reforma al COIP del 17 de febrero de 2021, lo que nos permite concluir que se está vulnerando el principio de irretroactividad de la ley.
The general objective of this research report was to analyze the application of the semi-open regime to those sentenced for the crime of illicit trafficking of scheduled substances subject to high-scale control, by the judges of penitentiary guarantees and to establish if there is a violation of the principle of non-retroactivity of the law. With the enactment and entry into force of the Organic Law Reforming the Comprehensive Organic Criminal Code, persons deprived of liberty who have been convicted of illicit trafficking in scheduled substances subject to high-scale control are excluded from access to the semi-open prison system, at least of other criminal types. Situation that is currently being applied by some judges of criminal guarantees, who are in charge of prison guarantees, without considering that the people sentenced for the crime of illicit trafficking of scheduled substances subject to high-scale control were sentenced prior to the validity of this exclusion, which would violate the principle of non-retroactivity of the law. For this, the inductive-deductive method, synthetic analytical method, logical historical method, the study techniques of particular cases, the interview, the analysis of documents and the instruments such as data sheets on particular cases, interview guide were applied. From the results obtained, it can be highlighted that in the applications for access to the semi-open regime presented by persons deprived of their liberty who have been convicted of illicit trafficking in scheduled substances subject to high- scale control, the reform to the COIP of 17 December is being applied.
