Resumen
La presente investigación tiene como objetivo general identificar, analizar y comprender cómo beneficia o perjudica la argumentación jurídica en el acceso a la justicia, para ello se implementa o utiliza el estudio y/o razonamiento de sentencias recopiladas de los boletines jurisprudenciales de la Corte Constitucional del Ecuador. De igual manera, la problemática que se va a describir en el presente trabajo es la deficiente o nula elaboración respecto a la argumentación jurídica que utilizan los operadores de justicia, siendo éste actualmente una gran carencia, puesto que al presentar fallas en su argumentación jurídica producen que se niegue el acceso a la justicia de las personas. En lo que respecta a la metodología se utiliza un enfoque cualitativo en donde se determinan los estándares que debe llevar una argumentación jurídica ser considerada correcta, coherente y satisfecha, esto se lo establece mediante la recopilación de información bibliográfica y científica procedente de tesis doctorales, sentencias relevantes, libros y artículos en internet. Esta investigación da como resultado el poder comprender si es válido que una sentencia sea derrocada o rechazada debido al proceso ineficiente de argumentación jurídica que presente el juez encargado del caso. En definitiva, como conclusión se establece que, uno de los procesos más importantes que debe cumplir un juez es la defensa de su argumentación jurídica, puesto que esta determina si el ciudadano tendrá cumplimiento a su derecho de acceso a la justicia o, caso contrario, será vulnerado.
ABSTRACT: The present investigation has the general objective of identifying, analyzing and understanding how legal argumentation benefits or harms access to justice, for which the study and/or reasoning of sentences compiled from the jurisprudential bulletins of the Constitutional Court of Ecuador is implemented or used. In the same way, the problem that is going to be described in the present work is the deficient or non-existent elaboration regarding the legal argumentation used by the justice operators, this being currently a great deficiency, since when presenting flaws in their legal argumentation they produce that people are denied access to justice. Regarding the methodology, a qualitative approach is used where the standards that a legal argument must carry to be considered correct, coherent and satisfied are determined, this is established by collecting bibliographic and scientific information from doctoral theses, relevant judgments, books and articles on the internet. This investigation results in being able to understand if it is valid for a sentence to be overturned or rejected due to the inefficient process of legal argumentation presented by the judge in charge of the case. In short, as a conclusion it is established that one of the most important processes that a judge must comply with is the defense of his legal argumentation, since this determines if the citizen will comply with his right of access to justice or, otherwise, he will be violated.
