La preclusión y la vulneración de derechos Constitucionales: la tutela judicial efectiva y Seguridad jurídica

Resumen
En las etapas procesales de un juicio civil existen momentos específicos para realizar una acción, no obstante, estos momentos mantienen un término en el cuál se pueden realizar, caso contrario, se pierde la oportunidad de hacerlo pues, una vez que precluye una acción, ya no se puede hacer nada al respecto, es decir, esta oportunidad se cierra o se pierde por completo, a esto se le denomina preclusión. Durante el transcurso de este estudio se pretende estudiar de manera crítica cómo la preclusión en los procesos legales puede vulnerar derechos constitucionales como el de la tutela judicial efectiva y seguridad jurídica, con el fin de recomendar soluciones que aborden estas preocupaciones en orden de promover un sistema legal más justo y equitativo. La metodología utilizada fue de enfoque cualitativo, mediante la utilización del método inductivo precisando la técnica de estudio de casos y herramientas como sentencias, normativas legales y doctrina jurídica que sea pertinente al tema de estudio. Se presentan resultados a partir del estudio de casos en donde se determinó que la preclusión se encontraba accionada y que las partes procesales no tuvieron la oportunidad de presentar prueba nueva a pesar de que esta era importante para los casos, lo que conllevó a un análisis crítico que concluye en la existencia de vulneración a los derechos constitucionales de tutela judicial efectiva y seguridad jurídica.
Abstract: In the procedural stages of a civil trial there are specific moments to perform an action, however, these moments maintain a term in which they can be performed, otherwise, the opportunity to do so is lost because, once an action is precluded, nothing can be done about it, in other words, this opportunity is closed or completely lost, this is called preclusion. During this study, the purpose is to critically study how preclusion in legal proceedings can affect constitutional rights such as effective judicial protection and legal security, with the goal of recommending solutions that address these concerns to promote a fairer and more equitable legal system. The methodology used was of qualitative approach, using the inductive method specifying the case study technique and tools such as sentences, legal regulations, and legal doctrine relevant to the subject of study. Results are presented from the case study where it was determined that the preclusion was activated and that the procedural parties did not have the opportunity to present new evidence even though it was important for the cases, which led to a critical analysis that concludes in the existence of a violation of the constitutional rights of effective judicial protection and legal certainty.
