Resumen
Esta investigación tiene por objetivo analizar la aplicación del procedimiento directo respecto de la garantía de imparcialidad de los sujetos procesales para determinar su vulneración. La problemática surge muy específicamente en los delitos flagrantes en los cuales el mismo Juez que dicta la prisión preventiva es quien conoce la audiencia de juicio directo, participando con criterios anticipados en la misma, ya que previamente conoció ciertos elementos y hechos que contaminan su objetividad e imparcialidad, siendo lo correcto que conozca la audiencia de juicio directo un Juez neutro, el cual solo a través de la práctica de los medios probatorios anunciados se empape de los hechos y con ello fundamente la sentencia que debe dictarse sea condenatoria o absolutoria . La metodología empleada en la investigación fue de tipo descriptiva, explicativa y relacional, además fue necesaria la utilización de técnicas como la revisión documental y la entrevista, con lo cual se pudo obtener los siguientes resultados: en cuanto a la revisión documental, se analizaron varios expedientes de la Unidad Penal del cantón Ibarra, concretamente de delitos flagrantes tramitados en procedimiento directo, determinando la vulneración de la garantía de imparcialidad ya que el mismo Juez que calificó la flagrancia y dictó prisión preventiva conoció la audiencia de juicio directo; además, con las entrevistas realizadas a los defensores públicos del cantón Ibarra se concluyó que, en su mayoría consideran que si existe la vulneración de la imparcialidad cuando se aplica el procedimiento directo a delitos flagrantes por los motivos expuestos anteriormente.
The objective of this investigation is to analyze the application of the direct procedure regarding the guarantee of impartiality of the procedural subjects to determine its violation. The problem arises very specifically in flagrant crimes in which the same Judge who dictates preventive detention is the one who knows the direct trial hearing, participating with anticipated criteria in it, since he previously knew certain elements and facts that contaminate his objectivity and impartiality, being the correct thing that a neutral Judge knows the hearing of direct trial, who only through the practice of the announced evidentiary means soaks up the facts and thereby bases the sentence that must be pronounced, be it conviction or acquittal. The methodology used in the research was descriptive, explanatory and relational, it was also necessary to use techniques such as documentary review and interview, with which the following results could be obtained: regarding the documentary review, several files of the Criminal Unit of the Ibarra canton, specifically of flagrant crimes processed in direct proceedings, determining the violation of the guarantee of impartiality since the same Judge who qualified the flagrante delicto and ordered preventive detention heard the direct trial hearing; In addition, with the interviews carried out with the public defenders of the Ibarra canton, it was concluded that, for the most part, they consider that there is a violation of impartiality when the direct procedure is applied to flagrant crimes for the reasons stated above.
