Resumen
El estado ecuatoriano en el área penal se rige al Código Orgánico Integral Penal también denominado “COIP”, esta investigación científica se propone indagar sobre su normativa en relación a la teoría de la tipicidad objetiva en el delito de robo Art. 189 por tal motivo es necesario conocer si dicha normativa tiene estipulados cada uno de elementos que constituyen la tipicidad objetiva. A fin de analizarlos o limitarlos de manera precisa ante una sentencia lo que correspondería realizar una motivación a la sentencia condenatoria - absolutoria, esta investigación se realizó en referencia al análisis de dos procesos con sentencia ejecutoriada con un análisis teórico tomando en consideración las fuentes del derecho entre los que se puede mencionar la doctrina, la jurisprudencia, la ley ecuatoriana y todas sus formas legales por otro lugar se realiza un análisis práctico-jurídico con una adecuada motivación por parte de los Jueces de Garantías Penales por el delito de robo, una vez identificado la responsabilidad del autor directo o sus diferentes denominaciones. Si bien es cierto el delito de robo por lo regular el autor o autores se acogen al procedimiento abreviado, también se hace notorio que la teoría de la tipicidad objetiva no está correctamente reglada en su procedimiento, La legislación ecuatoriana puede ser objeto de
nulidad procesal. Por tal motivo el desarrollo de esta investigación científica se sustenta en base a un problema jurídico, que se detalla a continuación: Los Jueces de Garantías Penales en el preciso momento de dictaminar una sentencia condenatoria o absolutoria toman en cuenta algunos elementos de la tipicidad objetiva en el delito de robo pero existen otros que no están claramente definidos en la normativa penal, siendo nombrados en dicha sentencia el sujeto activo indeterminado, sujeto pasivo indeterminado, verbo rector o conducta, objeto jurídico, objeto material y elemento normativo en el desarrollo de esta investigación notaremos que elementos no
están correctamente definidos por tal motivo al realizar esta investigación jurídica se utilizó una metodología científica y cualitativa con nivel relacional, descriptivo y explicativo, además se realiza un estudio documental dogmático de las teorías doctrinarias que determinan los elementos constitutivos de la tipicidad objetiva del análisis de las sentencias expedidas por la Unidad Judicial Penal de Iñaquito obteniéndose como resultado que los Juez de Garantías Penales, refieren a dichos elementos pero no sustentan de manera específica, por tal motivo se llega a la conclusión que los jueces al momento de dictar una sentencia condenatoria-absolutoria enuncia unos elementos de la tipicidad objetiva mientras a otros no los describen
ABSTRAC The Ecuadorian state in the criminal area is governed by the Organic Integral Criminal Code also called "COIP", this scientific research aims to inquire about its regulations in relation to the theory of objective typicity in the crime of theft Art. 189 For that reason, it is necessary to ascertain whether that legislation contains each of the elements constituting objective typicity. In order to analyze or limit them and in a precise manner before a sentence as it would be appropriate to make the motivation of a conviction or acquittal, this research was carried out in reference to two documentary analyses: one is the theoretical analysis taking into consideration the sources of law among which can be mentioned the doctrine, jurisprudence and Ecuadorian law and all its legal forms secondly a practical-legal analysis of a Adequate motivation on the part of the Judges of Criminal Guarantees in two sentences for the crime of theft, once the responsibility of the direct perpetrator or its different modalities has been identified, although it is true that the crime of theft usually such authors or author avail themselves of the abbreviated procedure, it is also notorious that the theory of objective imputation is not correctly regulated, its norm or procedure in Ecuadorian legislation, It may be subject to procedural nullity since there is a legal procedural vacuum. For this reason, the development of this scientific research is based on a legal problem, which is detailed below. The Judges of Criminal Guarantees at the time of issuing a conviction or acquittal take into account some elements of objective typicity but others are not clearly defined in criminal regulations, being named both the indeterminate active subject, indeterminate taxpayer, guiding verb or conduct, legal object, material object and normative element in order to carry out this legal research, a scientific and qualitative methodology was used with a relational, descriptive and explanatory level, in addition a dogmatic documentary study of the doctrinal theories that determine the constituent elements of the objective typicity in two sentences issued by the Criminal Judicial Unit of Iñaquito is carried out, obtaining as a result that the Judge of Criminal Guarantees, refer to these elements but do not support in a specific way, for this reason it is concluded that the judges at the time of issuing a conviction-acquittal enunciate some elements and do not describe them to others
