Resumen
La teoría del caso es una herramienta de organización de ideas de la causa, además involucra aquella exposición coherente y bien estructurada de los argumentos ante los jueces y los tribunales, lo que dependerá de la habilidad del profesional para demostrar que los testimonios son verídicos tal como los argumentos y alegatos presentados ya sea a favor o en contra del procesado. El objetivo del presente documento fue analizar la aplicación de la teoría del caso como técnica de litigación oral en procesos penales por medio de una investigación cualitativa-descriptiva. La metodología utilizada fue de tipo descriptiva con enfoque cualitativo, se generó una entrevista a dos juristas especialistas en tema de litigación oral. Los resultados expusieron que los entrevistados están totalmente de acuerdo con el artículo 501 del COIP que habla sobre el testimonio como medio concreto para convencimiento del juez, y del artículo 615 del COIP según la práctica de la prueba testimonial señale la declaración de los testigos como sujetos al interrogatorio y contrainterrogatorio de los sujetos procesales. Se concluyó entonces que la teoría del caso es uno de los elementos clave que se dan a conocer en la litigación oral, principalmente en la parte de alegato inicial donde se expone un resumen de los hechos.
The theory of the case is a tool for organizing ideas of the cause, it also involves that coherent and well-structured presentation of the arguments before the judges and the courts, which will depend on the ability of the professional to demonstrate that the testimonies are true as they are. the arguments and allegations presented either in favor of or against the defendant. The objective of this document was to analyze the application of case theory as an oral litigation technique in criminal proceedings through qualitative-descriptive research. The methodology used was descriptive with a qualitative approach, an interview was conducted with two lawyers specialized in oral litigation. The results showed that the interviewees fully agree with article 501 of the COIP, which talks about testimony as a concrete means to convince the judge, and with article 615 of the COIP, according to the practice of testimonial evidence, which indicates the testimony of witnesses as subjects. to the interrogation and cross-examination of the procedural subjects. It was then concluded that the theory of the case is one of the key elements disclosed in oral litigation, mainly in the initial argument part where a summary of the facts is presented.
