Resumen
En Ecuador, existen procedimientos tanto civiles como penales para tratar el delito de abuso de confianza. Sin embargo, a menudo se produce una desnaturalización del procedimiento al pasar de la vía civil a la penal. Esta desnaturalización se causa porque muchas denuncias por abuso de confianza no cumplen con los elementos necesarios para ser consideradas un delito penal, y, sin embargo, son presentadas como tales con el fin de buscar una conciliación. El objetivo de la presente investigación fue analizar la desnaturalización del procedimiento del abuso de confianza de la vía civil a la penal. Para ello, se utilizó una metodología mixta que incluyó entrevistas a
expertos en derecho civil y penal, incluyendo jueces y fiscales. Además, se examinaron las estadísticas de denuncias por el delito de abuso de confianza presentadas en la fiscalía de la Unidad de Soluciones Rápidas No-. 2, ubicada en el sector de la Mena 2 Sur de la ciudad de Quito, provincia de Pichincha. Entre los hallazgos más relevantes, se comprobó que es necesario adoptar medidas para evitar la desnaturalización del procedimiento del abuso de confianza y garantizar los derechos de las personas involucradas en este tipo de casos. También es importante considerar métodos de conciliación y mediación para lograr un camino eficiente en el derecho civil.
ABSTRACT: In Ecuador, there are both civil and criminal procedures to deal with the crime of breach of trust. However, the procedure is often distorted when it shifts from the civil to the criminal route. This distortion occurs because many complaints of breach of trust do not meet the necessary elements to be considered a criminal offense, yet they are still presented as such in order to seek reconciliation. The aim of this research was to analyze the distortion of the breach of trust procedure from the civil to the criminal route. A mixed methodology was used, which involved interviewing experts in civil and criminal law, including judges and prosecutors. In addition, statistics of complaints for the crime of breach of trust were examined, which were presented to the Rapid Solutions Unit No. 2 located in the Mena 2 Sur sector of the city of Quito, in the province of Pichincha. Among the most relevant findings, it was found that it is necessary to take measures to avoid the distortion of the breach of trust procedure and to ensure the rights of the people involved in these types of cases. It is also important to consider conciliation and mediation methods to achieve an efficient path in civil law.
